我国劳动合同单方即时解除制度研究

【摘要】:劳动合同单方即时解除是是劳动合同解除的一个重要环节。它既关系到劳动者的生活来源和自由劳动权,也关系到用人单位正常的生产经营管理秩序,在我国劳动法律制度中占举足轻重的地位。但是,随着我国劳资关系从固定用工到劳动力过剩再到就业难与用工荒并存,劳资博弈进入了新时期,劳动者与用人单位之间因劳动合同单方即时解除而产生的劳动争议明显增加。《劳动法》、《劳动合同法》等成文法的局限也随着时代的发展日趋明显,不能继续满足复杂多变的现实情况。 全文共分四部分。第一部分从劳动合同和劳动合同解除的基本概念和分类入手,对劳动合同单方解除的概念以及劳动合同单方即时解除的概念、法律特征和历史沿革等基本理论进行了阐述;第二部分立足我国劳动合同单方即时解除的法律规制,通过与国外的劳动法律制度进行比较,按照有无过错和行使解除权的主体分类,分别介绍了国内外劳动合同单方即时解除的法定情形,对其条件、程序作了详细阐述。第三部分通过分析我国劳动合同即时解除制度在理论和实践中存在争议的一些问题,从劳资双方利益保护、法律条文、法定情形、即时解除程序、法律后果及责任等五个方面分别指出这一制度存在的不足。第四部分针对我国现行法律规定中劳动合同单方即时解除制度存在的不足,以平衡好劳动者与用人单位的利益为切入点,从维护劳动者正当权益和酌情考虑用人单位实际情况的角度出发,在规范法律条文、增加限制性程序规定等方面就如何进一步完善劳动合同即时解除制度提出了立法建议。
[Abstract]:Unilateral immediate rescission of a labor contract is an important link in the termination of a labor contract. It not only concerns the source of life and the right to free labor of the laborer, but also relates to the normal order of production, operation and management of the unit of choose and employ persons. However, with the change of labor relations from fixed employment to surplus labor force to the coexistence of employment shortage and labor shortage, labor game has entered a new period. The labor disputes arising from the immediate termination of the labor contract between the laborer and the employing unit have obviously increased. The limitations of statutory laws such as the Labor Law and the Labor contract Law have become increasingly apparent with the development of the times. Can not continue to meet the complex and changeable reality. The paper is divided into four parts. The first part starts with the basic concept and classification of labor contract and labor contract rescission, the concept of unilateral termination of labor contract and the concept of immediate rescission of labor contract. The second part is based on the legal regulation of unilateral rescission of labor contract in our country, and compares it with the foreign labor law system. According to the classification of whether there is fault or not and the main body exercising the right of rescission, this paper introduces the legal situation of unilateral immediate rescission of labor contracts at home and abroad, The procedure is elaborated in detail. The third part analyzes some controversial issues in the theory and practice of the system of immediate rescission of labor contracts in China, including the protection of the interests of both employers and employees, the provisions of the law, the legal situation, and the immediate rescission procedure. The author points out the deficiency of this system in five aspects, such as legal consequence and liability. Part 4th aims at the deficiency of the system of unilateral immediate rescission of labor contract in our country. Starting from the point of view of balancing the interests of the laborer and the employing unit, and from the point of view of safeguarding the legitimate rights and interests of the laborer and considering the actual situation of the employing unit as appropriate, and standardizing the legal provisions, Some suggestions on how to perfect the system of immediate termination of labor contract are put forward.
