劳动合同法背景下民营企业劳资关系研究

【摘要】:《劳动合同法》实施五年以来,企业劳资关系整体上得到明显改善。作为我国经济的重要组成部分——民营企业,其现存的劳资双方如何协调进而达到健康良好的劳资关系,是本研究的研究目的。 本研究不同于前人的研究之处在于,本文是将我国《劳动合同法》作为协调民营企业劳资关系的大背景,以及对劳方和资方给予同样的话语权,公平分析劳资双方之间存在的关系。该研究的意义还在于引出对《劳动合同法》等相关法律法规在协调劳资关系等内容修订上提出建议。除此之外,劳资关系各主体——劳方、资方以及政府和工会等多方协调,对构建健康良好的民营企业劳资关系都应积极地互帮互助,从劳资双方的“双赢”,构建为劳资关系各方之间的“共赢”,为促进民营经济发展,进而促进我国整体经济发展提供和谐人文环境。 本研究在理论综述的基础上,结合之前学者对劳资关系模型的研究,从相关概念入手,对劳方和资方分别就劳资关系进行调查分析。对于劳方,本研究使用调查问卷、比较分析法,对员工感兴趣的劳动合同相关问题、工作环境、工资薪酬、福利待遇、工作时间以及对劳资纠纷的意见等方面进行调查。对于资方,本研究采用访谈法进行,访谈对象包括民营企业主以及一些人力资源管理者。通过对劳资双方的调查研究,分析民营企业劳资关系现状,以及2008年颁布实施的《劳动合同法》对民营企业劳资关系的多方面的影响。从上述研究,得出本文的“民营企业劳资关系协调机制模型”,并以该模型为基础,对民营企业劳资关系机制提出包括政府、工会、法律法规以及劳资双方在内的协调对策和建议如下:a,立法司法应兼顾公平,重视监督;b,劳资双方应寻求平衡,劳方应提升素质,资方应规范制度;c,工会应注重其维权职能,并协调好劳资双方关系以及与政府之间的关系;d,政府应发挥其监督职能,并在立法上提供保障。
[Abstract]:Since the implementation of the Labor contract Law five years ago, the overall labor-capital relations of enterprises have improved significantly. As an important part of China's economy, private enterprises, its existing labor and capital coordination to achieve a healthy and good labor relations, is the purpose of this study. This study is different from previous studies in that this paper regards the Labor contract Law of our country as the background to coordinate the labor relations between private enterprises, and gives the same right to labor and management. A fair analysis of the relationship between employers and employees. The significance of this study is to put forward some suggestions on the revision of the relevant laws and regulations, such as Labor contract Law, etc. In addition, the various subjects of labor-capital relations-labor, management, government and trade unions, and so on, should actively help each other to build a healthy and healthy private enterprise labor relationship, and from the "win-win" between the two sides, It provides a harmonious humanistic environment for promoting the development of private economy and promoting the overall economic development of our country. This study is based on the theoretical review, combined with previous scholars' research on the model of labor relations, starting with the relevant concepts, the labor and management respectively on the labor relations were investigated and analyzed. For the labor side, this study uses questionnaire, comparative analysis, to investigate the labor contract related problems, working environment, salary, welfare, working hours and opinions on labor disputes. For the management, the research adopts interview method, including private enterprise owners and some human resource managers. Through the investigation and research on both sides of labor and management, this paper analyzes the present situation of labor relations in private enterprises, and the influence of the Labor contract Law promulgated in 2008 on the labor relations of private enterprises. From the above research, this paper draws the "private enterprise labor relations coordination mechanism model", and on the basis of this model, puts forward the private enterprise labor relations mechanism including the government, trade unions, Laws and regulations, as well as the coordinated measures and suggestions of both sides of labor and management, are as follows: (a) legislation and administration of justice should take into account fairness, emphasis should be placed on supervision, employers and employees should seek a balance, workers should improve their quality, management should standardize the system, and trade unions should pay attention to their function of safeguarding rights. The government should give full play to its supervisory function and provide protection in legislation.
