医疗美容损害民事责任研究

【摘要】：随着经济的不断发展,人们在精神生活上的追求更加丰富,进入到医疗美容机构的美容者大军逐步壮大。科学技术的不断发展,医疗美容技术、药品、器械等得到升级换代,新的医疗美容技术一步步投放市场。医疗美容过程中发生多种多样的问题,这些问题亟需法律的规制和解决,对医疗美容损害民事责任问题的研究显得尤为重要。根据医疗美容行为的性质和特征,与医疗行为的性质和特征对比,可以发现二者具有一定程度上的相似性,主要适用《合同法》、《侵权责任法》、《医疗事故处理条例》等法律、法规及司法解释。在适用《合同法》时的精神损害赔偿制度的缺失,在适用《侵权责任法》时在医疗美容损害过错责任上的适用等问题仍是值得思考的,有关医疗美容损害的法律适用体系仍是需要不断发展和完善的。将严格责任原则适度的引入医疗美容损害责任问题中有现实必要。在特定情况下,严格责任原则在医疗美容损害侵权责任中加以适用,可以更好的维护整个医疗美容市场的健康发展,也可以更好的维护美容者的人身、财产利益。美容者在选择请求医疗美容机构承担违约责任还是侵权责任时,在归责原则、举证责任、诉讼时效、受诉法院等方面还是存在较大区别。在医疗美容损害责任承担中,精神损害赔偿被确立,但是现今仍没有具体的可以执行的标准,法官的在精神损害赔偿问题上的自由裁量权过大,在对医疗美容损害责任承担精神损害赔偿时可以从其他的法律法规中找到相关规定加以适用,将《医疗事故处理条例》中关于精神抚慰金的倍率式计算方式适当引入,以此解决精神损害赔偿标准的不具体、不量化。法律制度的完善是一个相对漫长的过程。对医疗美容损害民事责任的研究,能够使医疗美容中受到损害的美容者充分认识并懂得如何维护自身的权益,在市场活动中的医疗美容机构在进行经营活动的时候能够重视起本身的责任,进一步规范医疗美容机构自身实施的医疗美容行为,优化发展我国医疗美容行业。
[Abstract]:With the development of economy, people's pursuit of spiritual life is more and more abundant. With the continuous development of science and technology, medical beauty technology, medicine, equipment and so on have been upgraded, new medical beauty technology step by step put into the market. There are many kinds of problems in the process of medical beauty, which need to be regulated and solved by law, so it is very important to study the civil liability of medical beauty damage. According to the nature and characteristics of medical beauty behavior, and comparing with the nature and characteristics of medical behavior, we can find that the two have certain degree of similarity. They are mainly applicable to the laws of contract Law, Tort liability Law, Medical malpractice treatment regulations, etc. Statute and judicial interpretation. The lack of compensation system for mental damage in the application of the contract Law, and the application of the liability for medical and cosmetic damage in the application of the Tort liability Law are still worth considering. The law application system of medical beauty damage still needs to be developed and perfected. It is necessary to introduce the principle of strict liability into the problem of medical beauty damage liability. Under certain circumstances, the principle of strict liability can be applied in the tort liability of medical beauty damage, which can better maintain the healthy development of the whole medical beauty market, but also better safeguard the personal and property interests of the cosmetic person. There are still great differences in liability of liability, burden of proof, limitation of action, court of action and so on, when beauty person chooses to request medical beauty institution to bear liability for breach of contract or tort liability. In the medical beauty damage liability, the mental damage compensation has been established, but there is still no specific standards that can be implemented. The judge's discretion on the issue of compensation for mental damage is too large. We can find the relevant provisions from other laws and regulations to apply to the compensation for mental damage to the medical beauty damage liability, and introduce appropriately the method of calculating the scale of mental comfort money in the regulations on handling Medical malpractice. In this way, the standard of compensation for mental damage is not specific and quantitative. The perfection of legal system is a relatively long process. The research on the civil liability for medical beauty damage can make the beauty person who has been damaged in the medical beauty fully understand and know how to protect his own rights and interests. The medical and beauty organizations in the market activities can attach importance to their own responsibility, further standardize the medical beauty behavior of the medical and beauty organizations, and optimize the development of medical beauty industry in our country.
