文物艺术品鉴定机构民事责任与鉴定制度研究

【摘要】：时下，文物艺术品交易市场越来越繁荣，随之相伴的是文物艺术品鉴定行业的迅猛发展。然后文物艺术品鉴定行业的风气却不容乐观，“诚信缺失，道德败坏，虚假鉴定”的现象极其普遍，，这与目前我国文物艺术品鉴定行业缺乏相关的法律规制和行业自律有着必然的联系。在这种背景下，该行业相关鉴定机构、鉴定专家缺乏相应资质，水平良莠不齐，行业中缺乏诚信理念，惟利是从，文物艺术品持有人遭欺诈的的事情屡见不鲜。我国现行法律，如《文物保护法》、《拍卖法》、《合同法》等对文物艺术品鉴定方面的规定比较少且分散，缺乏完整的、系统的文物艺术品鉴定的法律制度。本论文旨在分析我国当前文物艺术品鉴定市场存在的问题，并提出解决对策；理清文物艺术品鉴定出现问题时各主体应承担的民事责任，探究我国现存关于文物艺术品鉴定行业的责任划分；对文物艺术品鉴定机构准入制度的建立提出笔者的见解，在借鉴其他相关的法律文献与研究论著研究的基础上深入挖掘，以求使研究内容亦丰富亦彻底。
[Abstract]:Nowadays, the market of cultural relics and works of art becomes more and more prosperous, accompanied by the rapid development of the industry of cultural relic art identification. Then the culture of cultural relics and works of art appraisal industry is not optimistic. The phenomenon of "lack of good faith, bad morals and false appraisal" is extremely common. This is related to the lack of relevant legal regulation and industry self-discipline in the field of cultural relic art identification in our country at present. In this kind of background, the industry related appraisal organization, the appraisal expert lacks the corresponding qualification, the level is intermingled, the profession lacks the good faith idea, but the benefit is from, the cultural relic art holder suffers the fraud the matter is common. The current laws of our country, such as the Law on the Protection of Cultural relics, the Law of auction, the contract Law, and so on, have relatively few and scattered provisions on the identification of cultural relics and works of art, and lack of a complete and systematic legal system for the identification of cultural relics and works of art. The purpose of this paper is to analyze the existing problems in the market of cultural relic art identification in China, and to put forward some countermeasures to solve the problems, and to clarify the civil liability of each subject when problems arise in the identification of cultural relics and works of art. This paper probes into the division of responsibilities in the field of cultural relic art identification in China, puts forward the author's opinion on the establishment of the entry system of cultural relics and works of art, and deeply excavates on the basis of drawing lessons from other relevant legal documents and research works.
