【摘要】：在我国经济发展的历程中,农业、农村和农民问题始终占据着重要地位,并且随着社会主义新农村与和谐社会的提出,解决“三农”问题就显得更为急迫。其中,发展农业是解决“三农”问题的基础,但农业又是最易受气候影响的脆弱行业,因此,完善的农业气象服务对农业减灾防灾,提高农业生产质量具有积极作用。而且2010年12月召开的中央农村工作会议对新时期加强“三农”工作和做好气象为农服务工作也提出了更高要求。可是,在我国的法制建设中,气象为农服务的法律机制建设却仍然很不完善。虽然我国已经出台了专门的气象法律,农业法律中也有了关于农业气象服务的规定,但是在我国广大农村,仍旧没有摆脱“靠天吃饭”的窘境。面对各种各样的气象灾害,农业气象服务法律在这时似乎都是“隐形”的,对预防气象灾害的发生和减少农业灾害经济损失没有发挥应有的作用。与当前迅速提高的国际地位相比,我国农业气象服务法律促进机制的发展比很多国家都落后。很多国家的农业气象法律已经达到了一个非常完善的阶段,再加上已有的农业技术基础,它们的农业生产效益远远高于中国。本论文旨在通过举例和对比的方法具体阐述气象服务法律促进机制对农业生产的重要作用,进而找出我国农业气象服务法律制度建设方面存在的不足,最终从经济法的视角提出农业气象服务法律促进机制的完善路径。总的来说,本论文主要有以下四大部分内容:第一部分阐述了农业气象服务法律促进机制的基本理论。本部分主要说明气象服务与农业生产的重要联系以及农业气象服务法律促进机制的具体含义,从而引出本文的主要研究对象。第二部分主要阐述了国外法律机制在促进农业气象服务发展方面的实践。本部分以举例论证的方法具体介绍了几个发达国家农业气象服务法律促进机制的实践经验,从而为我国农业气象服务法律促进机制的完善提供有益的借鉴。第三部分详述了我国农业气象服务法律促进机制的现状和存在的问题。本部分主要对当前我国农业气象服务法律的立法情况进行了一个比较详细的论述,从而找出当前我国农业气象服务法律机制的不足之处。第四部分则提出了我国农业气象服务法律促进机制的完善路径。本部分主要从经济法的视角,对如何完善我国的农业气象服务法律促进机制提出自己的观点,具体包括完善农业气象服务运作法律机制、财政法律机制、金融法律机制以及质量提升法律机制这四方面的内容。
[Abstract]:In the course of China's economic development, agriculture, rural areas and farmers have always occupied an important position, and with the new socialist countryside and a harmonious society put forward. It is more urgent to solve the problem of "agriculture, rural areas and farmers", among which, the development of agriculture is the basis of solving the problem of "agriculture, rural areas and farmers", but agriculture is the most vulnerable industry affected by climate. Perfect agricultural meteorological services to agricultural disaster reduction and prevention. Improving the quality of agricultural production plays a positive role. Moreover, the Central Rural work Conference held on December 2010 has strengthened the "three rural areas" in the new period. Work and do a good job of weather for the agricultural service also put forward higher requirements. In the legal construction of our country, the construction of the legal mechanism of meteorological service for agriculture is still very imperfect. Although our country has issued special meteorological laws, the agricultural laws also have the provisions on agricultural meteorological services. However, in the vast rural areas of our country, there is still no escape from the dilemma of "relying on heaven to eat". In the face of all kinds of meteorological disasters, the law of agricultural meteorological service seems to be "invisible" at this time. It does not play its due role in preventing the occurrence of meteorological disasters and reducing the economic losses of agricultural disasters. The development of the legal promotion mechanism of agricultural meteorological service in our country is behind that of many countries. The agricultural meteorological law of many countries has reached a very perfect stage in addition to the existing agricultural technical foundation. Their agricultural production benefit is much higher than that in China. This paper aims to illustrate the important role of meteorological service legal promotion mechanism in agricultural production by means of examples and comparisons. And then find out the shortcomings in the construction of the legal system of agricultural meteorological services in China, and finally from the perspective of economic law to put forward the perfect path of the legal promotion mechanism of agricultural meteorological services. There are four main contents in this thesis:. The first part describes the basic theory of the legal promotion mechanism of agricultural meteorological services. This part mainly explains the important relationship between meteorological services and agricultural production and the specific meaning of the legal promotion mechanism of agricultural meteorological services. The second part mainly expounds the practice of foreign legal mechanism in promoting the development of agrometeorological service. The practical experience of the legal promotion mechanism of meteorological service. The third part describes the current situation and existing problems of the legal promotion mechanism of agricultural meteorological service in China. The legislation of industry meteorological service law is discussed in detail. In order to find out the shortcomings of the current legal mechanism of agricultural meteorological service in China. Part 4th puts forward the perfect path of the legal promotion mechanism of agricultural meteorological service in China. This part mainly from the perspective of economic law. The author puts forward his own views on how to perfect the legal promotion mechanism of agricultural meteorological service, including the perfection of the legal mechanism of agricultural meteorological service operation and the legal mechanism of finance. Financial legal mechanism and quality improvement of the legal mechanism of the four aspects of the content.
