特大中心城市电力应急响应法律制度研究

【摘要】：电力稳定供给是特大中心城市经济社会发展的重要保证。作为区域中心的特大中心城市人口稠密，基础设施集中，城市用电量和电网负荷相对较高，以电力供应中断为特征的电力突发事件往往会造成规模性巨大损失，建构高效快速的电力应急制度具有急切性。在应急管理技术不断发展，应急响应能力却停滞不前的情势下，运用法律手段建立规范化的电力应急响应机制，则成为了特大中心城市应急法制建设的核心问题。电力突发事件的公共风险属性，决定了应急响应制度构建的根本目的是防灾减灾；特大中心城市电力突发事件的严重性和复杂性、应急响应的制度逻辑，为电力应急响应制度提供了构建进路：提高多元主体应对能力，，建立协同行动机制。纵观特大中心城市电力应急响应实战状况，应急响应体系的缺位、公众响应能力的不足使当前电力应急响应的缺陷得以突显，而应急管理体制的弊端和法律依据的困境成为了问题背后的深层制度原因。纽约市以市长负责制为核心的应急响应组织网络、多伦多市完备的应急响应法律体系，为我国特大中心城市电力应急响应制度的建立提供了可资借鉴的经验；然而，应急响应模式与程序的选择还应结合我国的具体情况予以借鉴。特大中心城市电力应急响应法制的构建，有赖于决策和执行两大系统的组建，分级响应与监督问责机制的建立，以及公众应急响应能力的提高。电力应急响应法治化进程的推进，将促进我国特大中心城市的稳定与繁荣。
[Abstract]:The stable supply of electric power is an important guarantee for the economic and social development of the mega-central city. As a regional center, the mega-central city has dense population, concentrated infrastructure, and relatively high power consumption and power grid load. Power emergencies characterized by power supply disruptions often cause huge losses on a large scale. It is urgent to construct an efficient and rapid power emergency system. Under the situation of stagnant emergency response ability, the establishment of standardized power emergency response mechanism by legal means has become the core problem in the construction of emergency legal system in mega-central cities. The public risk attribute of electric power emergencies determines that the basic purpose of the construction of emergency response system is disaster prevention and mitigation. The severity and complexity of power emergencies and the institutional logic of emergency response in the mega-central cities provide a way to build the power emergency response system: to improve the response ability of multiple subjects and to establish a cooperative action mechanism. Looking at the actual situation of electric power emergency response in mega-center city, the deficiency of emergency response system and public response ability make the defect of electric power emergency response prominent at present. The malpractice of emergency management system and the dilemma of legal basis become the deep institutional reasons behind the problem. The emergency response organization network with mayor responsibility system as the core in New York City and the complete emergency response legal system in Toronto provide the experience for reference for the establishment of electric power emergency response system in our country's mega-center city. However, the choice of emergency response mode and procedure should be used for reference. The construction of electric power emergency response system in mega-central cities depends on the establishment of decision-making and execution systems, the establishment of hierarchical response and the establishment of supervisory accountability mechanism. The improvement of public emergency response ability and the advancement of the process of power emergency response rule by law will promote the stability and prosperity of our country's mega-central cities.
