“人与自然和谐发展”的法治价值追求及其实现的路径选择

【摘要】："人与自然和谐发展"追求公平、正义、平等等法治的基本价值。它不仅关心人的发展的代内公平与代际公平问题,以及人们环境权利与义务的正义性问题,还主张人的发展的规范性,从而实现环境发展的公平性。它把人与自然看作相互依存的平等关系,体现出人类对自我发展的尊重与对自然价值尊重的统一;它拓展了权利、义务的内涵和外延,要求实现人的发展与自然的发展在权利义务方面的统一。我们应该确立符合"人与自然和谐发展"的立法精神和原则,制定并实施符合"人与自然和谐发展"的法律法规,从而使人与自然和谐发展所追求的法治价值得以实现。
[Abstract]:"harmonious development between man and nature" pursues the basic value of the rule of law, such as fairness, justice, equality and so on. It not only cares about the issue of intra-generational justice and intergenerational justice of human development, but also concerns the justice of people's environmental rights and obligations. It also advocates the standardization of human development so as to realize the equity of environmental development, which regards man and nature as interdependent and equal relations, and embodies the unity of human respect for self-development and respect for natural value; It expands the connotation and extension of rights and obligations, and demands the unity of rights and obligations between human development and natural development. We should establish the legislative spirit and principles that accord with the harmonious development of man and nature. Make and implement the laws and regulations which accord with the harmonious development of man and nature, so as to realize the value of the rule of law pursued by the harmonious development of man and nature.
