矿业权流转法律制度研究

【摘要】：矿业权流转法律制度是一项重要制度，对它进行研究具有重要的现实意义。本文通过五个部分来对矿业权流转法律制度进行研究。第一部分主要对矿业权进行的研究。矿业权是矿产资源所有权所派生出来的重要权利，它由探矿权和采矿权组成。关于矿业权的性质，学者们一直存在争议。笔者认为，矿业权是一项特殊的物权，我们称它为准物权。矿业权具有物权的排他效力、优先效力、追及效力以及具有物上请求权。但是，由于矿业权客体的不特定性，所以又不是典型的物权。由于矿业权常常关系着国家利益、战略意义，因而它又具有公权的属性，，是具有公权属性的私权。本文的第二部分主要介绍国外的矿业权流转法律制度以及我国矿业权流转法律制度的确立过程。改革开放以前，我国法律禁止矿业权的转让，直到1996年修改《矿产资源法》后，矿业权转让才被允许。矿业权流转法律制度的建立是经济发展与对外开放的必然结果，具有重要意义。笔者认为，矿业权流转法律制度应该有一套基本的原则，那就是公开、公平竞争原则，可持续发展原则，国家宏观调控原则。本文的第三部分用较大的篇幅介绍了笔者认为的矿业权流转法律制度所包含主要内容，主要包括：(1)矿业权流转的主体及法律条件：(2)矿业权流转审批登记制度；(3)矿业权评估机制；(4)矿业权市场机制。矿业权流转法律制度的内容是研究该制度的基础，所以有必要对其内容作详细的分析、归纳。文章的第四部分主要是分析矿业权流转法律制度存在的问题并提出完善的建议。矿业权流转法律制度在我国建立的时间较短，还存在一些不成熟的方面。土地权利与矿业权的冲突法律上没有很好地协调，矿业权人的合法权利没有得到充分的保障，矿业权评估机制还不够完善，矿业权市场也还不够成熟。对此，笔者分别提出了自己完善的建议。环境问题是社会非常关注的问题，环境保护是矿业权流转过程中不容忽视的问题。文章第五部门专门针对矿业权流转与环境保护问题作出分析，对它们之间关系的协调笔者提出了自己的建议。
[Abstract]:The legal system of mining right circulation is an important system. It is of great practical significance to study it. This paper studies the legal system of mining right circulation through five parts. The first part mainly studies mining right. Mining right is derived from the ownership of mineral resources. An important right to come out. It is composed of prospecting right and mining right. About the nature of mining right, scholars have been controversial. The author thinks that mining right is a special real right, we call it quasi real right. Mining right has exclusive effect of real right. Because the object of mining right is not specific, so it is not a typical real right. Because mining rights are often related to the national interests, strategic significance. Therefore, it has the attribute of public power. The second part of this article mainly introduces the foreign legal system of mining right circulation and the establishment process of our country mining right circulation legal system. Before the reform and opening up. The law of our country forbids the transfer of mining rights until 1996 after the amendment of the Mineral Resources Law the transfer of mining rights is not allowed. The establishment of legal system for the circulation of mining rights is the inevitable result of economic development and opening to the outside world. The author thinks that the legal system of mining right circulation should have a set of basic principles, that is, open, fair competition principle, sustainable development principle. The third part of this paper introduces the main contents of the legal system of mining right circulation. It mainly includes: 1) the subject and legal condition of mining right circulation: 2) the examination and approval registration system of mining right circulation; (3) the evaluation mechanism of mining rights; The content of the legal system of mining right circulation is the basis of the study of this system, so it is necessary to make a detailed analysis of its content. The 4th part of the article mainly analyzes the problems existing in the legal system of mining right circulation and puts forward some suggestions. The legal system of mining right circulation has been established in China for a short time. There are still some immature aspects. The conflict between land rights and mining rights has not been well coordinated, the legal rights of mining owners have not been fully protected, and the evaluation mechanism of mining rights is not perfect. Mining rights market is also not mature. To this, the author put forward their own suggestions. Environmental issues are very concerned by the society. Environmental protection is a problem that can not be ignored in the process of mining right circulation. The author puts forward his own suggestions on the coordination of the relationship between mining right circulation and environmental protection.
