煤区生态补偿法律制度研究

【摘要】：长期以来,作为支柱能源之一的煤炭资源为我国经济和社会发展做出了巨大贡献,煤炭资源的开发利用,不可避免的对区域环境产生了巨大影响,要解决以煤炭能源为经济支柱地区的区域环境问题,就必须根据煤炭区域环境特点及其特定的环境问题采取因地制宜的有效措施,而煤区生态补偿制度的设置正是立足于实现对资源的可持续利用,谋求人与自然和谐共处的有效途径。所以,研究煤区生态补偿法律制度在完善区域性生态补偿理论、丰富环境立法内容、发挥煤区经济优势缓解区域生态问题、保障煤区环境保护资金投入、消除经济的负面环境影响、实现煤区经济可持续发展方面都具有重要的理论和实践意义。本文采用文献梳理、典型案例分析、实证分析的方法,首先从煤区生态补偿的界定入手,对其研究必要性及其理论和实践价值进行论证,认为煤区生态补偿法律制度在实现煤区可持续发展、保护煤区生态保护者利益、确保煤区生态环境保护的资金投入、保障煤区生态与区域经济协调发展方面具有重要意义。其次从法学视角,对法理学中效率、正义、公众参与、国家环境管理权、环境法律责任、可持续发展原则和权利义务等基础理论与煤区生态补偿之间的关系进行分析,阐述了煤区生态补偿的法理学基础,为煤区生态补偿法律制度的建立搭建法理学支撑平台。在此基础上,结合我国当前煤区生态补偿法律制度国内研究现状,指出我国当前生态补偿规定法律结构不平衡、法律内容不完善的不足,通过比较分析德国、美国、加拿大、哥斯达黎加、日本等国的相关制度,阐述了国外生态补偿法律制度在收费目的、征收方式、产权确定、评价体系构建、制度建设、模式选择等多个方面的规定对我国煤区生态补偿法律制度建立的启示。最后从煤区生态补偿法律制度的建立和完善入手,依照法律渊源,从法律体系的整体出发,分别提出了对完善宪法、环境保护法、自然资源保护单行法、刑法的若干设想,并着重对制定《煤区生态补偿条例》提出建议,详细阐明了条例中应涉及的补偿原则、补偿对象、补偿方式、补偿标准等方面的内容,对我国煤区生态补偿法律制度的未来进行了展望。为保证法律法规的有效落实,本文还从环保宣传、绿色GDP制度建立等方面为生态补偿制度提出了外部环境的构建。
[Abstract]:For a long time, coal resources, as one of the pillar energy sources, have made great contributions to the economic and social development of our country. The exploitation and utilization of coal resources inevitably have a great impact on the regional environment. In order to solve the regional environmental problems in the areas where coal energy is the mainstay of the economy, it is necessary to take effective measures according to local conditions according to the environmental characteristics of coal regions and their specific environmental problems. The establishment of ecological compensation system in coal area is based on the realization of sustainable utilization of resources and an effective way of harmonious coexistence between man and nature. Therefore, the study on the legal system of ecological compensation in coal area is improving the theory of regional ecological compensation. Enriching the content of environmental legislation, giving full play to the economic advantages of coal areas to alleviate regional ecological problems, ensuring the investment of environmental protection funds in coal areas, and eliminating the negative environmental impact of the economy, It is of great theoretical and practical significance to realize the sustainable economic development of coal area. This paper uses the methods of literature combing, typical case analysis and empirical analysis, starting with the definition of ecological compensation in coal area, the necessity of its research and its theoretical and practical value are demonstrated. It is considered that the legal system of ecological compensation in coal areas is of great significance in realizing the sustainable development of coal areas, protecting the interests of ecological protectors in coal areas, ensuring the investment of funds for the protection of ecological environment in coal areas, and ensuring the coordinated development of ecology and regional economy in coal areas. Secondly, from the perspective of law, this paper analyzes the relationship between the basic theories of law, such as efficiency, justice, public participation, national environmental management right, environmental legal responsibility, principles of sustainable development, rights and obligations, and ecological compensation in coal areas. This paper expounds the legal basis of ecological compensation in coal area, and sets up a legal support platform for the establishment of legal system of ecological compensation in coal area. On this basis, combined with the current domestic research status of ecological compensation legal system of coal area in China. This paper points out that the current legal structure of ecological compensation in China is not balanced and the legal content is not perfect. Through comparative analysis of the relevant systems in Germany, the United States, Canada, Costa Rica, Japan and other countries, This paper expounds the enlightenment of the foreign legal system of ecological compensation on the establishment of ecological compensation legal system of coal region in China in the aspects of the purpose of charging, the way of collection, the determination of property right, the construction of evaluation system, the construction of system, the choice of mode and so on. Finally, starting from the establishment and perfection of the legal system of ecological compensation in coal areas, according to the legal origin and the whole legal system, this paper puts forward some tentative ideas of perfecting the constitution, the environmental protection law, the special law of natural resources protection and the criminal law, respectively. It also puts forward some suggestions on the formulation of the regulations on Ecological compensation in Coal areas, and expounds in detail the principles of compensation, the object of compensation, the ways of compensation, the standard of compensation, and so on, which should be dealt with in the regulations. In order to ensure the effective implementation of laws and regulations, this paper also puts forward the construction of external environment for ecological compensation system from the aspects of environmental protection propaganda and the establishment of green GDP system.
