我国遗传资源保护法律制度研究

【摘要】: 20世纪70年代,美国科学家对人类DNA重组成功,生物基因工程以及与之相关的生物技术有了长足的进步,在这种背景下,生物中所包含的遗传基因对人类所具有的潜在价值逐步呈现出来。我国是一个生物多样性大国,有着丰富的生物资源,蕴含着极具潜力的遗传资源。为了促使遗传资源更好的为中国的社会主义现代化建设提供战略支持,有必要对遗传资源进行有效地保护和管理。文章按照从一般到特殊的写作方式,对我国遗传资源保护法律制度进行构建和完善。 首先,从解释遗传资源保护法律制度的相关概念入手,在比较国际组织、相关国家以及我国对相关遗传资源定义的基础上,确定本文所探讨的遗传资源范围。对遗传资源保护的两层含义进行分析,并考察了遗传资源保护的历史演变,使得对遗传资源保护问题有一个初步的认识和了解。 其次,对国外遗传资源保护立法进行了考察,例如具有典型代表意义的澳大利亚昆士兰州遗传资源立法和安第斯共同体、哥斯达黎加、巴西等几个发展中国家遗传资源立法。同时,密切关注遗传资源相关的国际立法,分析其中对我国具有借鉴意义的立法成果,以更好的为我国遗传资源保护立法工作的开展提供经验和借鉴。 再者,通过对国内遗传资源的保护现在分析和考察,指出我国目前遗传资源保护工作中存在的问题并分析其产生的原因,以期为我国遗传资源保护立法建设提出解决问题的一种思路。 最后,通过汲取国外遗传资源立法的经验和教训,并结合本国国情深入分析目前国内遗传资源的现状,提出构建我国遗传资源保护法律制度的具体框架。从指导思想、具体的制度建设二个方面着手,其中具体制度建设包含权属制度、搜集整理制度、惠益分享制度、获取制度等几个方面,通过对遗传资源保护法律制度的全方位构建,以最终达到保护我国遗传资源并合理利用的目标。
[Abstract]:In 1970s, American scientists made great progress in human DNA recombination, biological genetic engineering and related biotechnology. The potential value of the genetic genes contained in organisms to human beings is gradually emerging. China is a large country of biodiversity with rich biological resources. In order to promote genetic resources to provide strategic support for China's socialist modernization, It is necessary to protect and manage the genetic resources effectively. First of all, from the interpretation of the legal system of genetic resources protection related concepts, in comparison with international organizations, relevant countries and China on the basis of the definition of relevant genetic resources, This paper determines the scope of genetic resources discussed in this paper, analyzes the two meanings of genetic resources protection, and examines the historical evolution of genetic resources protection, which makes it possible to have a preliminary understanding and understanding of the protection of genetic resources. Secondly, foreign legislation on the protection of genetic resources has been examined, such as the Queensland genetic Resources legislation of Australia and the Andean Community, Costa Rica. Brazil and several other developing countries have legislated on genetic resources. At the same time, they have paid close attention to the international legislation related to genetic resources, and analyzed the legislative achievements which are of significance to our country. In order to better the development of genetic resources protection legislation in China to provide experience and reference. Furthermore, through the analysis and investigation on the protection of domestic genetic resources, this paper points out the problems existing in the current protection of genetic resources in China and analyzes the reasons for the occurrence of these problems. In order to solve the problem for the legislation construction of genetic resources protection in China. Finally, by drawing on the experience and lessons of foreign genetic resources legislation and analyzing the current situation of domestic genetic resources, this paper puts forward the concrete framework of constructing the legal system for the protection of genetic resources in China. There are two aspects of the specific system construction, including the ownership system, the collection and arrangement system, the benefit-sharing system, the access system, and so on, through the omni-directional construction of the legal system for the protection of genetic resources. In order to finally achieve the goal of protecting our country's genetic resources and utilizing them reasonably.
