建设“两型社会”语境下对立法机关环保监管模式研究

【摘要】：“两型社会”作为新的国家发展理念,不仅为整个社会指明了新的发展方向,而且提出了一系列新的要求。我国的立法机关作为履行立法、监督等职权的主体对建设“两型社会”无疑具有重要的地位和作用。但是,立法机关在履行职权过程中既充当了“运动员”又扮演着“裁判员”,存在着大量不利于资源节约、环境友好的行为并产生了相对应的不利影响或危害后果,却几乎不受任何监管。在“两型社会”建设语境下对立法机关环保监管模式研究,就是要使立法机关的履职行为,尤其是行为可能产生的结果符合建设“两型社会”的目标要求。
[Abstract]:As a new concept of national development, "two-oriented society" not only points out a new direction of development for the whole society, but also puts forward a series of new requirements. The subject of supervision and other functions and powers undoubtedly plays an important role in building a "two-oriented society". However, in the process of performing its functions and powers, the legislature not only acts as a "athlete" but also as a "umpire", which is not conducive to the conservation of resources. Environmentally friendly acts have corresponding adverse effects or harmful consequences, but they are hardly subject to any supervision. In the context of the construction of a "two-type society", the study on the mode of environmental protection supervision of the legislature is to enable the legislature to carry out its duties. In particular, the possible consequences of behavior meet the goal of building a "two-oriented society".
