我国环境立法的反思与完善

【摘要】： 受1972年斯德哥尔摩人类环境会议的积极影响,我国开始关注环境问题并重视环境法制工作。自1979年制定《环境保护法(试行)》以来,我国的环境法制建设虽然只有三十年的历史,但从立法的数量和涉及的领域看,已经取得了巨大的成就。然而,我国污染严重、资源短缺、生态失衡的问题并没有得到根本的好转,我们的环境立法在面对业已成为我国经济社会深入发展的瓶颈和约束的环境安全和资源安全问题还显得捉襟见肘和力不从心。反思我们的环境立法的质量,可知其存在诸多不足:立法指导思想上落后;环境立法体系尚不健全,还存在立法空白,相关立法之间的关系没有理顺等现象;环境法律制度的建设不足,尚有制度真空、制度滞后和制度衔接不畅等不良现象;立法技术还不成熟,立法冲突、立法漏洞和可操作性不强的问题还比较突出…… 面对挑战,我们必须坚持以科学发展观为指导,坚持以建设生态文明和构建资源节约型和环境友好型社会为目标,秉持可持续发展、科学民主、权利本位、公平正义和务实高效的立法理念,及时修改我国的《环境保护法》为统领环境立法体系的基本法,适时制定《土壤污染防治法》、《环境损害赔偿法》和《农村环境保护条例》等法律法规,不断修改各单行环境立法,健全和完善我国的环境法律制度,有序“绿化”传统部门立法,从而为保障和促进现代化的环境法治奠定正义、科学、坚实的法制基础。为此,我们的环境立法工作者,必须不断加强环境科学、生态学等自然科学知识的学习,注重法学理论素养的提升,既要放眼世界又要立足国情着力提高法律移植的水平,本着解放思想、实事求是和以人为本的精神,在法律汇编、法律编纂、法律清理和法律后评估的基础上,妥善地处理好法律的立、改、废问题,不断提高环境立法技术,改善环境立法质量,为环境法治建设作出更多更大的贡献。
[Abstract]:Under the positive influence of the Stockholm Conference on the Human Environment in 1972, China began to pay attention to environmental problems and environmental legal work. Although the construction of environmental legal system in our country is only 30 years old, it has made great achievements in terms of the quantity of legislation and the fields involved. However, the pollution in our country is serious and the resources are short. The problem of ecological imbalance has not fundamentally improved. In the face of the problems of environmental security and resource security which have become the bottleneck and constraint of our country's economic and social development, our environmental legislation is still overstretched and powerless. We can see that there are many shortcomings: the guiding ideology of legislation is backward, the environmental legislation system is not perfect, there are still legislative gaps, the relationship between relevant legislation is not straightened out, the construction of environmental legal system is insufficient, there is institutional vacuum, and so on. The bad phenomena such as lagged system and unsmooth connection of system, immature legislative technique, legislative conflict, legislative loophole and weak maneuverability are still outstanding. In the face of challenges, we must adhere to the guidance of the scientific development concept, adhere to the goal of building ecological civilization and building a resource-saving and environment-friendly society, uphold sustainable development, scientific democracy, and rights-oriented, Fair, just, pragmatic and efficient legislative concepts, and timely revision of China's Environmental Protection Law as the basic law governing the environmental legislation system, Timely formulation of laws and regulations such as the Law on Prevention and Control of soil pollution, the Law on compensation for Environmental damage, and the regulations on Environmental Protection in Rural areas, etc., to constantly revise the separate environmental legislation, and to improve and perfect our country's environmental legal system. Orderly "greening" the legislation of traditional departments, thus laying a just, scientific and solid legal foundation for ensuring and promoting the modern environmental rule of law. Therefore, our environmental legislator must constantly strengthen the study of natural science knowledge, such as environmental science and ecology, and pay attention to the improvement of legal theory literacy. We should not only look at the world but also focus on improving the level of law transplantation based on the national conditions. In the spirit of emancipating the mind, seeking truth from facts and putting people first, and on the basis of the compilation of laws, the compilation of laws, the cleaning up of laws and the post-evaluation of laws, we should properly handle the problems of the establishment, reform and abolition of laws, and constantly improve the technology of environmental legislation, Improve the quality of environmental legislation and make more and more contributions to the construction of environmental rule of law.
