【摘要】：中国是农业大国,各种自然资源、自然生态系统主要在农村,广大农村地区既是自然资源的发祥地,同时也是生态建设的薄弱地带,农村及农民的环境权益必须得到社会各界足够的重视。当前农村环保工作要着眼于让农村居民喝上干净的水,呼吸到新鲜的空气,吃上放心健康的食物,为此,必须着眼于农村水环境的综合治理工作特别是农村水污染的综合防治工作。有鉴于法律手段在农村水污染防治领域的步履维艰,本文主要以分析我国农村水污染防治现状为基础,在众多成因中既有我国环境立法的整体落后与城乡差异的外部成因,也有立法者对农村水污染防治立法不重视、农村环保意识尚不强烈等内部成因。从而指出法律规定的欠缺对农村水污染治理工作的重大影响,包括法律法规不健全、无法可依、立法层次低及新《水污染防治法》仍旧未能解决的若干问题等等,同时适时分析了出现的执法与司法现状。另外,本文分析了以美国、日本、韩国、欧盟等国外发达国家的农村水污染防治法律研究情况及各国的立法实践,总结出确立可持续生态环境保护理念、强化农村水污染防治的政府职能、确立农村水污染防治的相关机制等方面可供借鉴的经验启示,并从立法、执法、司法、强化法律监督和环保意识培养五个方面探讨如何从法治层面完善我国农村水污染防治体系的建设。
[Abstract]:China is a large agricultural country. All kinds of natural resources and natural ecosystems are mainly in rural areas. The vast rural areas are not only the birthplaces of natural resources, but also the weak areas of ecological construction. The environmental rights and interests of rural areas and farmers must receive adequate attention from all walks of life. Current rural environmental protection work should focus on making rural residents drink clean water, breathe fresh air, and eat safe and healthy food. We must focus on the comprehensive management of the rural water environment, especially the comprehensive prevention and control of rural water pollution. In view of the difficulty of legal means in the field of water pollution prevention and control in rural areas, Based on the analysis of the current situation of rural water pollution prevention in China, this paper mainly analyzes the causes of the external causes of the overall backwardness of our environmental legislation and the differences between urban and rural areas, and the fact that some legislators do not attach importance to the legislation of rural water pollution prevention and control. Rural environmental awareness is not yet strong and other internal causes. Thus pointing out that the lack of laws and regulations on rural water pollution control work, including the lack of sound laws and regulations can not be followed, At the same time, it analyzes the present situation of law enforcement and judicature at the same time.
