开采海洋油田的环保法律问题研究

【摘要】：二十一世纪无疑已成为海洋世纪,工业社会几十年高速发展已让陆地资源几近走向枯竭,而海洋面积巨大,石油资源蕴藏丰富,世界各国纷纷将眼光投向了海洋。而随着海洋石油勘探活动的频繁增加,尚未成熟的海洋石油开采技术已给海洋生态环境造成了无法忽视的损害。为规范海洋油田开采活动,完善海洋油田勘探开发过程中的环境保护制度亟需提上议事日程。笔者旨在分析国内外关于海洋油田开采环境保护法律规制现状进行分析的基础上,借鉴国外海洋治理的成功经验,结合我国海洋治理的国情现状,为制定我国特有的海洋油田开采环境保护的专项立法献计献策。本文第一部分重新定义了海洋油田的概念并对开采现状作了必要描述,为全文的展开奠定基础。第二部分对国际条约、各海洋强国关于油污损害先进的立法经验、我国国内关于海洋油田开采环境保护有关立法现状进行阐述。第三部分分析了国际条约在立法方面的不足之处和我国在海洋油田开采过程中的环境保护立法中的不足之处,以便后文有针对性地提出法律建议。第四部分从国内外立法、执法、司法角度提出我国在海洋油田开采过程中环境保护立法应当改进的措施。本文创新点有:1、在国内率先从环境保护单角度着手对海洋油田勘探进行讨论研究;2、在比较国际法当中以及世界海洋强国对于海洋环境保护的先进制度的基础上,借鉴国际和各国立法实践经验,力求为系统构建我国海洋石油勘探开发环境保护法律体系提出良性建议。3、完善海洋油田勘探开发的环境保护应当同时兼顾法律人才队伍的培养。
[Abstract]:The 21 century has undoubtedly become the ocean century, and the rapid development of the industrial society for decades has made the land resources nearly depleted. However, the sea area is huge and the oil resources are rich, so many countries all over the world have turned their eyes to the sea.With the frequent increase of offshore oil exploration activities, the immature offshore oil exploration technology has caused unnegligible damage to the marine ecological environment.In order to standardize the exploitation of offshore oil fields and improve the environmental protection system in the process of exploration and development of offshore oil fields, it is urgent to put it on the agenda.The purpose of this paper is to analyze the present situation of legal regulation on the environmental protection of offshore oil field exploitation at home and abroad, and to draw lessons from the successful experiences of foreign countries, and to combine the current situation of marine governance in our country.To make special legislation on environmental protection of offshore oilfield exploitation in China.In the first part of this paper, the concept of offshore oil field is redefined and the present situation of exploitation is described.In the second part, the international treaties, the advanced legislative experience of various marine powers on oil pollution damage, and the current situation of domestic legislation on the environmental protection of offshore oil exploitation in China are expounded.The third part analyzes the shortcomings of international treaties in legislation and environmental protection legislation of our country in the process of exploitation of offshore oil fields, so as to put forward some legal suggestions.The fourth part puts forward the measures to improve the environmental protection legislation of our country in the process of exploitation of offshore oil fields from the aspects of legislation law enforcement and judicature at home and abroad.The innovation of this paper is: 1, the first in China to discuss and study the exploration of offshore oil fields from the single angle of environmental protection, and on the basis of comparing the international law and the advanced systems of marine environmental protection of the world's marine powers.Based on the experience of international and other countries, this paper tries to put forward some good suggestions for the systematic construction of the legal system of environmental protection for offshore oil exploration and development in our country, and to perfect the environmental protection of offshore oil exploration and development should also take into account the cultivation of legal personnel at the same time.
