【摘要】：生态系统是自然最美的创造,野生动物是生态系统中不可缺少的部分。野生动物存在造就了更加缤纷的地球家园。野生动物及其栖息地为人类提供了大量的物质资源,促进社会的发展。同时,野生动物及其栖息地也遭到巨大的破坏。野生动物及其栖息地具有不可估量的生态价值,因此我们要对野生动物及其栖息地进行保护。目前,野生动植物及其栖息地保护工作是我国生态文明建设的重要部分。保护野生动物及其栖息地对维护生态平衡、生物的多样性,进行科学技术研究有着重要的作用。我国野生动植物资源比较丰富,并且栖息地的类型多样,但目前野生动物栖息地的保护不尽人意,存在着栖息地范围没有明确界定、栖息地保护与经济发展之间存在矛盾、栖息地丧失与破碎化严重等等问题。而保护野生动物栖息地是维持我国生态平衡的需要,是我国经济发展的需要,是我国社会发展的需要。保护野生动物及其栖息地最终是保障人类的生存繁衍。从国际社会来看,环境问题越来越受到重视。国际间为保护环境达成大量的国际公约,用以保护我们赖以生存的家园,追求人与自然的和谐相处。从国际各国来看,运用法律手段保护野生动物及其栖息地已经成为一种趋势。本文总共有四部分,第一部分是本文的引言部分,主要说明了本文选题的目的和意义,介绍了国内外野生动物栖息地保护研究现状,提出了文章的具体思路及方法,并说明了文章中的创新点。第二部分,介绍了野生动物栖息地保护当中基础概念及其相关概念,如自然保护区、风景名胜区和野生动物园。介绍了我国野生动物栖息地保护的现状和我国野生动物栖息地法律保护的必要性。第三部分,主要介绍了我国野生动物栖息地法律保护现状及存在的主要问题。保护现状从国际和国内两个方面进行说明,并提出了我国野生动物栖息地法律保护中存在立法体系不完善、栖息地划分范围不科学、监管机制不健全、公众参与不完善等的问题。第四部分,对第三章中提出的问题进行完善,内容主要从三个方面介绍。首先,如制定一部专门的野生动物栖息地保护所需要的立法原则;其次,在现阶段如何对现有的法律进行修改;再次,要加强国际条约的国内适用。本文在撰写过程中,研究了大量的文献资料,提出了具体的解决办法,期望本文能够有助于我国在野生动物及其栖息地保护方面的法律的完善,对我国野生动物栖息地保护与经济发展创造双赢局面做一些参考,从而在维护生态平衡和可持续发展中发挥作用,促进我国野生动物保护事业的长远发展。
[Abstract]:The ecosystem is the most beautiful creation of nature, and wildlife is an indispensable part of the ecosystem.The existence of wild animals has created a more colorful home on earth.Wild animals and their habitats provide a great deal of material resources for human beings and promote the development of society.At the same time, wildlife and its habitat have also suffered tremendous damage.Wildlife and its habitats are of inestimable ecological value, so we should protect wildlife and their habitats.At present, wildlife and its habitat protection is an important part of ecological civilization construction in China.Protecting wildlife and its habitat plays an important role in maintaining ecological balance, biodiversity and scientific and technological research.China is rich in wildlife resources, and the types of habitats are diverse, but the protection of wildlife habitat is not satisfactory, there is no clear definition of habitat scope, and there is a contradiction between habitat protection and economic development.Habitat loss and fragmentation are serious problems.The protection of wildlife habitat is the need to maintain the ecological balance of our country, is the need of the economic development of our country, is the need of the social development of our country.The protection of wildlife and its habitat is ultimately to ensure the survival and reproduction of human beings.From the point of view of the international community, more and more attention has been paid to environmental issues.The international community has reached a large number of international conventions for the protection of the environment, in order to protect the homeland on which we live and to pursue the harmony between man and nature.From the international point of view, the use of legal means to protect wildlife and their habitats has become a trend.There are four parts in this paper. The first part is the introduction of this paper, which mainly explains the purpose and significance of this paper, introduces the current situation of wildlife habitat protection at home and abroad, and puts forward the specific ideas and methods of the article.And explained the innovation point in the article.The second part introduces the basic concepts and related concepts of wildlife habitat protection, such as nature reserves, scenic spots and wildlife parks.The present situation of wildlife habitat protection in China and the necessity of legal protection of wild animal habitat in China are introduced.The third part mainly introduces the current situation and main problems of wildlife habitat protection in China.The present situation of protection is explained from the international and domestic aspects, and it is pointed out that the legislative system is not perfect, the range of habitat division is not scientific, and the regulatory mechanism is not perfect in the legal protection of wildlife habitat in China.The problem of imperfect public participation, etc.The fourth part, the third chapter raises the question to carry on the consummation, the content mainly introduces from three aspects.First of all, such as the development of a special wildlife habitat protection necessary for the legislative principles; secondly, at this stage, how to amend the existing law; thirdly, to strengthen the domestic application of international treaties.In the course of writing, we have studied a lot of literature, put forward concrete solutions, and hope that this paper will be helpful to improve the law of wildlife and its habitat protection in our country.This paper makes some references for the protection of wildlife habitat and economic development in China to create a win-win situation so as to play a role in maintaining ecological balance and sustainable development and promote the long-term development of wildlife protection in China.
