我国应对全球变暖的立法研究

【摘要】： 工业革命以来,人类排放的大量温室气体导致气候变暖。气候变化问题已经成为当今人类亟待解决的重大社会问题。全球气候变暖会导致海平面升高、冰川、冻土融化以及湖泊水位下降等严重的危害。全球变暖对人类生存造成严重的威胁,旱涝灾害、海啸、台风等极端气候发生的频率增加。我国二氧化碳排放量已超过美国,跃居世界第一,并且我国人口众多、经济发展水平较低、生态环境脆弱,是最容易遭受全球变暖不利影响的国家之一。为了将全球变暖给我国带来的危害降至最低,加强对全球变暖立法刻不容缓。我国在应对全球变暖的立法上还存在诸多不足,主要表现在:立法体系上存在漏洞,缺乏可操作性的具体制度,对于一些违法行为的处罚也较轻。人们的全球变暖危机意识不强,相关部门缺乏法治理念。应对全球变暖制定应对气候变化法迫在眉睫。文章提出了我国应对全球变暖的法律对策:首先,在《宪法》中确立应对全球变暖的立法思想:科学发展观。其次,修订我国现行应对气候变化的相关规范。最后,制定一部应对全球变暖的气候变化法。英、美等发达国家在制定应对气候变化法方面有着先进的立法经验,本文在结合我国具体国情的基础上,借鉴国外先进立法经验,提出制定减缓气候变化技术的开发转让制度、设立独立监管机构的监管体制等具体的法律措施。
[Abstract]:Since the Industrial Revolution, human emissions of greenhouse gases have led to climate warming.The problem of climate change has become a major social problem to be solved urgently.Global warming can cause serious damage from rising sea levels, melting glaciers, frozen soil and falling lake levels.Global warming poses a serious threat to human survival, drought and flood disasters, tsunamis, typhoons and other extreme weather increased frequency.China's carbon dioxide emissions have surpassed that of the United States, ranking first in the world, and our country has a large population, a low level of economic development and a fragile ecological environment, which is one of the countries most vulnerable to the adverse effects of global warming.In order to minimize the harm of global warming to our country, it is urgent to strengthen the legislation on global warming.There are still many deficiencies in the legislation to deal with global warming in our country, which are mainly manifested in the following aspects: there are loopholes in the legislative system, lack of specific system to operate, and the punishment for some illegal acts is also relatively light.People's awareness of global warming crisis is not strong, the relevant departments lack the concept of the rule of law.It is urgent to develop a climate change response to global warming.This paper puts forward the legal countermeasures to deal with global warming in China: first of all, it establishes the legislative thought of global warming in the Constitution: the scientific concept of development.Next, revise our country's current response to climate change related norms.Finally, develop a climate change law to combat global warming.The United Kingdom, the United States and other developed countries have advanced legislative experience in formulating laws to deal with climate change. Based on the specific conditions of our country and drawing on the advanced legislative experience of foreign countries, this paper proposes to formulate a system for the development and transfer of technologies to mitigate climate change.The establishment of independent regulatory bodies regulatory system and other specific legal measures.
