完善我国预防窃电立法刍议

【摘要】： 窃电是一种具有严重社会危害性的行为,它不仅造成供电企业电量损失,国有资产流失,经济效益下降,而且容易对公民人身、财产造成威胁。笔者在工作中发现,目前上海的窃电现象是很严重的。造成这种状况的原因:一是由于舆论和学界对公共财产保护的宣传有意或无意的漠视,滋长了公民乃至企业损公肥私的思想,使窃电现象得以蔓延;二是由于我国相关法律法规的不完善,导致供电企业在反窃电检查、取证、处理等方面的难度加大。要解决这些问题,有必要制定专门的预防窃电法。笔者在文章中对窃电的相关问题,如窃电的概念和特点、现行窃电立法的构架、作用、不足等,进行了较为深入的分析,并对完善我国预防窃电立法的宗旨、立法原则、主要内容提出了自己的见解,希望通过本文为完善我国预防窃电立法起到抛砖引玉的作用。
[Abstract]:Electricity theft is a kind of serious social harm behavior, it not only causes electricity loss of power supply enterprises, the loss of state-owned assets, the decline of economic benefits, but also easy to pose a threat to citizens' personal and property.In my work, I found that the current phenomenon of electricity theft in Shanghai is very serious.The causes of this situation are as follows: first, the publicity of public property protection intentionally or unintentionally ignored by public opinion and academic circles, which nurtured citizens and even enterprises' thought of losing public wealth, and made the phenomenon of electricity theft spread;Second, due to the imperfection of relevant laws and regulations in our country, it is more difficult for power supply enterprises to check, obtain evidence and deal with electricity theft.To solve these problems, it is necessary to formulate a special law to prevent electricity theft.In this paper, the author makes a deep analysis of the problems related to electricity theft, such as the concept and characteristics of electricity theft, the framework, function and insufficiency of the current electricity theft legislation, and makes a more thorough analysis of the purpose and principle of perfecting the legislation on the prevention of electricity theft in our country.The main content put forward own opinion, hoped through this article to consummate our country to prevent the electricity theft legislation to play the role of the brick and mortar.
