【摘要】： 物权法的出台给集体林业物权制度的研究带来了一系列新课题。为了使集体林业物权相关制度更完善,更好地顺应经济发展的时代潮流,明晰集体林业产权、激发林农参与集体林业生产建设的积极性,促进集体林业经济的发展,更是为了满足客观生态环境对于林业物权制度建设所提出的要求,必须从生态角度出发,全面看待作为一个生态整体的林业物权制度体系。集体林业物权制度体系十分复杂,需要从集体林业所有权、用益物权、抵押担保物权、相邻关系和地役权、占有、林业生态补偿等诸多方面展开研究,且每一个环节的研究都应当将环境保护的最新理念充分融入传统物权制度。特别是对于宪法、物权法、有关集体林业方面的一些经济法、行政法等部门法的立法精神需要进行深入研究,使得集体林业物权制度在不与有关法律精神相冲突的前提下,能增加和创新一些更适应林业发展特色的制度。比如在集体林业物权制度体系中增加一些《物权法》没有明确规定而确实有利于规范林业产权的制度、制定适宜的集体林业采伐权指标以及集体公益林与商品林的划分制度、建议完善集体林业占有制度、建立林业新型地役权、完善林业金融抵押担保制度等。另外,制定《集体林条例》非常重要。改条例的立法目的在于进一步确定集体林业物权制度、明晰集体林业产权制度,规范林权设立变更、转让、消灭,促进集体林业的公益性和经济效益的双赢;其基本原则有保护生态环境优先原则、最大程度保护集体林业的经济利益原则、统一规定且区别对待、因地制宜的原则;其基本制度包括集体林权证登记制度、相关劳动和利益分配制度、集体林业承包经营制度和集体林地承租经营制度、集体林业抵押担保制度、集体林业采伐指标分配制度、集体林地相邻关系和地役权的制度以及集体公益生态林的补偿制度。总而言之,集体林业物权制度研究是一项宏大的系统研究,其目的在于实现我国林业经济的高效、可持续发展,并且从最大程度上保护生态环境。
[Abstract]:The introduction of real right law has brought a series of new topics to the study of collective forestry real right system.In order to make the relevant system of collective forestry real right more perfect, better conform to the trend of economic development, clarify collective forestry property right, stimulate the enthusiasm of forest farmers to participate in collective forestry production and construction, and promote the development of collective forestry economy.In order to meet the requirements of the objective ecological environment for the construction of forestry real right system, it is necessary to treat the forestry real right system as an ecological whole from the ecological point of view.The system of collective forestry real right is very complex, which needs to be studied from the aspects of collective forestry ownership, usufruct right, mortgage security right, adjacent relationship and easement, possession, forestry ecological compensation, etc.And the research of each link should fully integrate the latest idea of environmental protection into the traditional real right system.In particular, the legislative spirit of the constitution, property law, some economic laws on collective forestry and administrative law need to be deeply studied, so that the system of collective forestry property rights does not conflict with the relevant legal spirit.To increase and innovate some more suitable for forestry development characteristics of the system.For example, adding some "real right law" to the system of collective forestry property right system, which is not clearly stipulated but is indeed conducive to standardizing forestry property rights, establishing appropriate collective forestry logging right indicators and the division system between collective public welfare forest and commercial forest.It is suggested to perfect collective forestry possession system, establish new forestry easement, and perfect forestry financial mortgage guarantee system.In addition, the formulation of the Collective Forest regulations is very important.The legislative purpose of the reform regulations is to further determine the real right system of collective forestry, to clarify the system of collective forestry property rights, to standardize the establishment, change, transfer and elimination of forest rights, and to promote the win-win situation of public welfare and economic benefits of collective forestry.Its basic principles include the principle of priority in protecting the ecological environment, the principle of protecting the economic interests of collective forestry to the maximum extent, the principle of unified provisions and differential treatment, and the principle of taking measures according to local conditions; its basic system includes the registration system of collective forest rights certificates,The relevant labor and benefit distribution systems, the collective forestry contract management system, the collective forest rental management system, the collective forestry mortgage guarantee system, the collective forestry logging index distribution system,The system of adjacent relation and easement of collective forest land and the compensation system of collective public welfare ecological forest.In a word, the study of collective forestry real right system is a great systematic study, whose purpose is to realize the high efficiency and sustainable development of forestry economy in our country, and to protect the ecological environment to the greatest extent.
