水污染物排放许可制度研究

【摘要】：随着环境问题的日益恶化,对于环境保护的手段也在不断的多元化发展。水排污物排放许可制度作为水污染防治的支柱性制度,已经为世界上大多数国家所采用并已发展较为完善。我国的水污染物排放许可制度作为排污许可制度中最为完善的一项制度,自1987年实施以来,已有20余年历史,其在防治水环境污染、规范水污染物排放行为中,都发挥了极其重要的作用。在其发展过程中,我国颁布了《水污染防治法》、《水污染防治法实施细则》、《水行政许可听证规定》等相关法律法规,对我国的水污染物排放许可制度起到了一定完善作用。但时至今日,该制度立法仍然不尽完善,存在一定缺陷和问题。本文除引言和结语外,共分为四章。第一章对水污染物排放许可制度进行了制度上的概说,对其上位概念及其自身的涵义、特征、功能进行了阐述,为后文奠定理论基础。第二章介绍我国水污染物排放许可制度的发展历史及制度现状,同时对我国水污染现状进行分析。其中着重从适用法律依据、适用范围、实施程序、听证程序、监督检查制度五个方面对我国目前水污染物排污许可制度进行具体分析。第三章经过第二章的铺陈,对我国水污染物排放许可制度存在的问题进行了分析,目前主要存在着理念上、法律规范上、程序设计上以及监管制度上四方面的缺陷和问题,影响了我国水污染物排放许可制度作用的全面发挥。第四章针对前文问题进行进一步探析,在第三章对存在问题进行了充分的铺垫后,有的放矢的针对问题提出了完善的措施和建议。希望通过这一系列措施和建议,能够集中解决问题,促使我国水污染物排放许可制度的更快发展。
[Abstract]:With the worsening of environmental problems, the means of environmental protection are developing in various ways.As a pillar system of water pollution prevention and control, the water discharge permit system has been adopted and developed in most countries in the world.China's water pollutant discharge permit system, as the most perfect one in the sewage permit system, has been implemented for more than 20 years since its implementation in 1987. It has been used in the prevention and control of water environmental pollution and the regulation of discharge behavior of water pollutants.Has played an extremely important role.In the course of its development, China promulgated the Water pollution Prevention and Control Law, the detailed rules for the implementation of the Water pollution Prevention and Control Law, and the provisions for the hearing of Water Administrative Licensing, and so on, which has played a certain role in perfecting the water pollutant discharge permit system in China.But up to now, the system legislation is still imperfect, there are certain defects and problems.In addition to the introduction and conclusion, this article is divided into four chapters.The first chapter gives a general introduction to the water pollutant emission permit system, expounds its upper concept and its own meaning, characteristics and functions, and lays a theoretical foundation for the following articles.The second chapter introduces the development history and present situation of water pollutant emission permit system in China, and analyzes the present situation of water pollution in China.In this paper, the author analyzes the current water pollutant discharge permit system in China from five aspects: the applicable legal basis, the scope of application, the implementation procedure, the hearing procedure and the supervision and inspection system.The third chapter analyzes the problems existing in China's water pollutant emission permit system through the elaboration of the second chapter. At present, there are mainly four defects and problems in concept, legal norm, program design and supervision system.It affects the function of water pollutant emission permit system in our country.The fourth chapter makes a further analysis of the previous problems, after the third chapter of the existing problems, the author puts forward some perfect measures and suggestions to solve the problems.It is hoped that through this series of measures and suggestions, we can concentrate on solving the problem and promote the rapid development of the water pollutant emission permit system in China.
