论渔业行政执法中的若干问题

【摘要】：渔业行政执法是我国行政执法在渔业领域的具体体现,是渔业行政执法机关依法行政的重要内容。渔业行政执法工作的有效开展对推进依法治渔、保障人民生命财产安全、维护渔民合法权益发挥着重要作用。因而加强渔业行政执法研究,对于加快建立责权明确、行为规范、监督有效、保障有力的渔业行政执法体制具有重要的理论意义和现实意义。本文运用行政法的相关原理,对渔业行政执法的概念、内容和特征进行了分析,阐述了渔业行政执法的内涵,进而在此基础上采用理论和实际相结合的方法分析了渔业行政执法在执法主体、执法行为、救济途径、监督机制等四方面存在的突出问题,剖析了形成这些问题的原因,主要有渔业行政执法立法不完备、渔业行政法制环境未形成、渔业行政执法对象特殊、渔业行政执法人员法律素质不高。在此基础上提出了完善渔业行政执法的四点设想:完善渔业行政执法立法建设,规范渔业行政执法行为,构建渔业行政执法监督机制,加强渔业行政给付机制。第一部分阐述了渔业行政执法的内涵。本文采取的是狭义的行政执法观点,渔业行政执法是指渔业行政执法机关及其执法人员为了实现国家行政管理目的,在行使行政职能过程中,贯彻实施渔业法律、法规,依法对行政相对人采取直接影响其权利义务,或者对相对人权利的行使和义务的履行情况进行监督检查的具体行政行为。渔业行政执法具有一般行政执法的特征,又具有区别其它行政执法的特殊属性,要深刻阐述渔业行政执法的内涵必须明确其执法内容和执法特征。渔业行政执法的内容包括渔业行政许可、渔业行政处罚和渔业行政给付。渔业行政执法的特征主要表现为渔业行政执法主体特定、渔业行政执法依据法定、渔业行政执法目的具有公益性、渔业行政执法内容具有专业性、渔业行政执法对象特殊。第二部分分析了我国渔业行政执法现状及原因。渔业执法主体分散表现为渔业行政执法机关与相邻行政机关之间,以及渔业行政执法机关内部各部门的执法冲突;渔业执法行为不规范表现为渔业执法主体、执法内容和执法程序不规范;渔业行政执法救济途径不完善表现为行政复议制度尚不健全和行政复议机构缺乏独立性;渔业行政执法监督机制不完善主要从外部监督和内部监督两方面进行论述;渔业行政执法存在问题原因探析主要从渔业行政执法立法不完备、渔业行政法制环境未形成、渔业行政执法对象特殊、渔业行政执法人员法律素质不高这四方面进行了深刻的剖析。第三部分提出了完善渔业行政执法的对策。笔者就完善渔业行政执法立法建设、规范渔业行政执法行为、构建渔业行政执法监督机制和加强渔业行政给付机制这四方面提出了构想。完善渔业行政执法立法建设主要从明确各部门立法权限、立法规划制定超前和定期进行法规清理三方面进行阐述;规范渔业行政执法行为主要从规范渔业行政执法主体、执法内容和执法程序三方面进行阐述;构建渔业行政执法监督体制主要从外部监督和内部监督两方面进行阐述;加强渔业行政给付机制主要从执法对象弱势群体的概念、弱势群体的成因和健全渔业行政给付制度三方面进行了阐述。
[Abstract]:The administrative law enforcement of fishery is the concrete embodiment of the administrative law enforcement in the fishery field and the important content of the administration of fishery administration law enforcement organs. The effective development of fishery administrative law enforcement work plays an important role in promoting the law governing fishing, ensuring the safety of the people's life and property and safeguarding the legitimate rights and interests of the fishermen. Therefore, the study of fishery administration enforcement is strengthened. It is of great theoretical and practical significance to speed up the establishment of clear responsibilities, norms, effective supervision and effective protection of fishery administrative law enforcement system.
This paper analyzes the concept, content and characteristics of fishery administrative law enforcement by using the relevant principles of administrative law, expounds the connotation of fishery administrative law enforcement, and then analyses the four aspects of the fishery administrative law enforcement in the law enforcement body, law enforcement behavior, relief approach and supervision mechanism by combining theory with practice. The reasons for the problems are analyzed, including the incomplete law enforcement legislation of fishery administration, the lack of the legal environment for fishery administration, the special law enforcement object of fishery administration and the low legal quality of the fishery administrative law enforcement personnel. On this basis, the four ideas of perfecting the fishery administrative law enforcement are put forward: perfecting the legislation of fishery administrative law enforcement. Set up, regulate fishery administrative law enforcement behavior, construct fishery administrative law enforcement supervision mechanism, and strengthen fishery administrative payment mechanism.
The first part expounds the connotation of fishery administrative law enforcement. This article takes a narrow sense of administrative law enforcement. Fishery administrative law enforcement refers to the implementation of fishery laws and regulations in the exercise of administrative functions in the process of exercising administrative functions by fishery administrative law enforcement agencies and their law enforcement officers in order to achieve the purpose of State Administration. The specific administrative acts that affect their rights and obligations, or supervise and inspect the performance of the rights of the relative persons or the performance of their obligations. Fishery administrative law enforcement has the characteristics of general administrative law enforcement and special attributes to distinguish other administrative law enforcement. It is necessary to elaborate the connotation of the law enforcement of fishery administration and the law enforcement of its content and law enforcement. The contents of fishery administrative law enforcement include fishery administrative license, fishery administrative punishment and fishery administration payment. The characteristics of fishery administrative law enforcement are mainly manifested in the specific subject of fishery administrative law enforcement, the law enforcement of fishery administration is legal, the purpose of fishery administration law enforcement is public welfare, the administrative content of fishery administration is professional, and fishery administration is executive. The object of the law is special.
The second part analyzes the current situation and reasons of fishery administrative law enforcement in China. The main body of fishery law enforcement is the conflict between the administrative law enforcement organs of Fisheries and the adjacent administrative organs, as well as the internal departments of the fishery administrative law enforcement organs, and the irregular behavior of fishery law enforcement acts as the main body of fishery law enforcement, and the law enforcement content and law enforcement procedures are not standardized. The imperfection of the remedy for fishery administration law enforcement is that the system of administrative reconsideration is not perfect and the administrative reconsideration institution lacks independence; the imperfect supervision mechanism of fishery administration law is mainly discussed from two aspects of external supervision and internal supervision; the reasons for the problems of fishery administrative law enforcement are mainly from the incomplete law enforcement legislation of fishery administration, The fishery administrative legal environment has not formed, the fishery administrative law enforcement object is special, the fishery administrative law enforcement personnel's legal quality is not high, these four aspects have carried on the profound analysis.
The third part puts forward the countermeasures to improve the law enforcement of fishery administration. The author puts forward some ideas on perfecting the legislative construction of fishery administrative law enforcement, regulating the law enforcement behavior of fishery administration, constructing the supervision mechanism of fishery administrative law enforcement and strengthening the mechanism of fishery administration payment, and perfecting the legislative construction of fishery administration law mainly from the clear legislative powers of various departments. Limit, three aspects of legislative planning are formulated ahead of time and regular regulation is carried out. The regulation of fishery administrative law enforcement is mainly from three aspects of standardizing the subject of fishery administration, the content of law enforcement and the procedure of law enforcement; the construction of fishery administrative law enforcement supervision system mainly from two aspects of external supervision and internal supervision; Industrial administrative payment mechanism is mainly elaborated from three aspects: the concept of vulnerable groups of law enforcement objects, the causes of vulnerable groups and the improvement of fishery administrative payment system.
