【摘要】： 环境问题日益成为世人瞩目的焦点。尤其是日益发展的城市化以及城市人口的急剧增加,不仅使得人类的生活空间日益缩小,而且也使得人类的居住环境受到越来越多的侵扰和损害。因相邻关系而产生的各方对彼此间生活环境侵害的种类和数量都在不断增多。而环境保护相邻权主体追求的是居住环境或生活环境的清洁与宁静以及精神上的愉悦和舒畅。侵犯环境保护相邻权的行为,会给权利人带来精神上、肉体上甚至生命的损害,而现有法律制度对环境保护相邻权的规定又不尽如人意。因此,对环境保护相邻权做以深入研究,从而完善现有的环境保护相邻权法律制度,对保障环境保护相邻权主体生活环境的舒适安逸以及建设和谐社会具有重要的现实意义。本文从环境保护相邻权的概念入手,分析了相邻权、环境权和环境保护相邻权的区别,以及我国环境保护相邻权的现状和存在的问题,介绍了国外部分国家有关环境保护相邻权的法律制度。然后针对我国实际情况,提出在我国法律中应当确立环境保护相邻权的法律地位,并在此基础上拓宽救济方式和途径;同时注重在城市规划的合理设计,从而从源头上减少侵害环境保护相邻权的可能性。
[Abstract]:Environmental issues have increasingly become the focus of attention. Especially the increasing urbanization and the rapid increase of urban population not only make the living space of human being shrink day by day but also make the living environment of human being suffer more and more interference and damage. The variety and quantity of each side's encroachment on each other's living environment is increasing. The subject of environmental protection pursues the cleanliness and tranquility of the living environment and the spiritual pleasure and comfort. The act of infringing on the neighboring right of environmental protection will bring mental, physical and even life damage to the right holder, but the existing legal system is not satisfied with the stipulation of the neighboring right of environmental protection. Therefore, it is of great practical significance to study the adjacent rights of environmental protection in order to perfect the existing legal system of neighboring rights of environmental protection and to ensure the comfort and comfort of the living environment of the subjects of adjacent rights of environmental protection and to build a harmonious society. This paper starts with the concept of neighboring right of environmental protection, analyzes the difference among adjacent right, environmental right and adjacent right of environmental protection, and the present situation and existing problems of adjacent right of environmental protection in China. This paper introduces the legal system of neighboring right of environmental protection in some foreign countries. Then according to the actual situation of our country, it is proposed that the legal status of the neighboring right of environmental protection should be established in our country's law, and on this basis, the relief ways and means should be broadened, and the reasonable design of urban planning should be emphasized. Thus the possibility of encroaching on the neighboring right of environmental protection can be reduced from the source.
