我国海水资源开发及利用的法律制度研究

【摘要】：当前我国水资源现状及海水利用产业发展良好,可是目前并未出台专门关于海水资源开发和利用的法律、法规以及规章,只是有一些法律法规跟海水开发利用有关。美国很早就认识到了在海水资源开发利用方面法律所发挥的作用,"科技+法律"成为推动美国海水资源开发的选择,法律可以有效保障和促进海水利用科学技术的发展。本文参考了我们国家当前的水资源现实情况和海水资源开发利用方面的发展情况,对相关问题和资料进行了进一步的研究,形成自己的写作思路。首先,结合我国水资源现状及海水利用产业发展势头,以深圳市为例介绍了我国海水资源开发利用情况,对我国海水资源开发和利用的法制现状做了分析。其次,介绍了国外有关海水资源开发利用的法律制度。国外主要参考了美国的相关实践,指出对我国的经验和启示;最后,也是本文的主旨,学习国外优秀经验并联系我国的实际国情,对推进我们国家海水资源开发及利用的法律制度的建设提出建议。希望借此可以为有关部门和学术机构提供一些参考,为我们国家海水开发利用产业的良性高效发展贡献绵薄之力。
[Abstract]:The present situation of water resources and the industry of seawater utilization in China are developing well, but there are no laws, regulations and rules on the exploitation and utilization of sea water resources, but there are some laws and regulations related to the exploitation and utilization of sea water. The United States has long recognized the role of the law in the exploitation and utilization of sea water resources. "Science and technology law" has become the choice to promote the development of seawater resources in the United States, and the law can effectively guarantee and promote the development of science and technology in seawater utilization. Referring to the current situation of water resources in our country and the development of the exploitation and utilization of sea water resources, this paper makes further research on the relevant problems and materials, and forms its own writing ideas. Firstly, according to the present situation of water resources and the development trend of seawater utilization industry in China, taking Shenzhen City as an example, this paper introduces the situation of exploitation and utilization of seawater resources in China, and analyzes the present situation of the legal system of exploitation and utilization of sea water resources in China. Secondly, the foreign legal system about the exploitation and utilization of seawater resources is introduced. Foreign countries mainly refer to the relevant practices of the United States, and point out the experience and enlightenment to our country. Finally, it is also the main purpose of this paper, to learn from foreign excellent experience and to contact the actual situation of our country. To promote the development and utilization of seawater resources in our country, the legal system construction is put forward. It is hoped that this will provide some references for relevant departments and academic institutions and contribute little to the benign and efficient development of our country's seawater development and utilization industry.
