我国防治外来物种入侵法律问题研究

【摘要】： 外来物种入侵已经成为生物多样性丧失的主要原因之一,其对生态安全和生物多样性的危害已经得到国际社会的广泛关注,许多国家已积极行动起来,制定了大量的法律文件,应对日益严重的外来物种入侵问题。我国己成为外来物种入侵最严重的国家之一,但是由于我国对外来物种入侵的研究起步比较晚,相关法律规定具有明显的滞后性,为了应对外来物种入侵对我国生态安全和生物多样性的威胁,当前亟需完善立法,健全外来入侵物种管理体制。首先,我国应当制定应对外来物种入侵的专项法律,加快形成以《中华人民共和国环境保护法》为指导,以外来物种入侵防治法为主体,以单项法律法规规章为补充的立法体系,综合指导我国外来物种入侵防治工作。其次,建立一个常设综合协调机构,通过立法授予这个机构在外来物种入侵管理方面较高的法律地位,有效协调国家各部门、中央和地方的管理工作。最后,在完善立法、建立综合协调机构的基础上完善风险评估机制、跟踪监测机制、早期预警机制、以及责任追究机制。
[Abstract]:The invasion of alien species has become one of the main causes of loss of biodiversity, and its harm to ecological security and biodiversity has received widespread attention from the international community, and many countries have taken active action and developed a large number of legal documents, To deal with the growing problem of invasive alien species. China has become one of the most serious invasive countries of alien species. However, due to the late start of the research on alien species invasion in China, the relevant laws and regulations have obvious lag. In order to deal with the threat of alien species invasion to ecological security and biodiversity in China, it is urgent to perfect the legislation and improve the management system of alien invasive species. First of all, China should formulate special laws to deal with the invasion of alien species, accelerate the formation of the "Environmental Protection Law of the people's Republic of China" as the guide, and take the Law on the Prevention and Control of invasive species as the main body. The legislation system, supplemented by individual laws and regulations, provides comprehensive guidance for the prevention and control of alien species in China. Secondly, a permanent integrated coordinating body should be established, which, through legislation, would have a higher legal status in the management of invasive alien species and effectively coordinate national, central and local management. Finally, on the basis of perfecting the legislation and establishing the comprehensive coordination mechanism, we should perfect the risk assessment mechanism, the tracking and monitoring mechanism, the early warning mechanism, and the accountability mechanism.
