【摘要】：矿产资源的非可再生性决定了它是一国经济、社会发展以及人民生活的重要物质保障。我国又是世界上矿产资源较为丰富、矿种较为齐全的少数国家中的一个，其中有20多种矿产的探明储量位居世界前列。然而我国为了发展经济，，对矿产资源的开发利用也造成了一定程度的破坏，同时在此过程中也忽视了由此引发的一系列矿山环境问题以及与其相伴而生的各种社会问题。矿山环境的急剧恶化已经严重影响了矿区人民的生活质量和生活环境，也阻碍着整个社会经济的正常发展。本文通过对矿山环境治理的法律制度进行概述，从我国矿山环境问题的现状入手，分析建立矿山环境治理法律制度的法律依据，依照现存的矿山环境问题，对建立矿山环境治理法律制度的必要性进行分析。就我国现存的矿山环境治理法律制度而言，从立法现状和相关法律制度两个方面的现状入手，探究制度不健全所存在的缺陷。同时通过借鉴美国和澳大利亚治理矿山环境方面的经验，进而提出建立我国矿山环境治理法律制度的建议。通过完善已有的相关法律法规，依靠先进的科学技术与制度创新，在坚持清洁生产原则、坚持环境法“谁受益、谁治理”原则、坚持“开发与保护并举”的基础上，做到从源头上降低矿山环境问题发生的可能性，构建完善的矿山环境治理法律制度，进而积极开展矿山环境治理工作，有效遏止矿山环境进一步恶化，从而真正实现人口、资源与环境的和谐与可持续发展。可以说，建立矿山环境治理法律制度不仅可以弥补并完善我国环境法律制度，同时为督促矿山企业进行环境保护也提供了有力的法律保障。
[Abstract]:The non-renewable mineral resource determines that it is an important material guarantee for a country's economy, social development and people's life. China is also one of the few countries with abundant mineral resources and complete mineral resources in the world. Among them, 20 kinds of proven reserves of mineral resources are among the top in the world. However, in order to develop the economy, the exploitation and utilization of mineral resources in China has caused some damage to a certain extent, and a series of mine environmental problems and various social problems associated with them have been neglected in the process. The rapid deterioration of mine environment has seriously affected the quality of life and living environment of the people in mining area, and also hindered the normal development of the whole society and economy. By summarizing the legal system of mine environmental control, starting with the present situation of mine environmental problems in China, this paper analyzes the legal basis for establishing the legal system of mine environmental management, and according to the existing mine environmental problems, The necessity of setting up legal system of mine environmental control is analyzed. As far as the existing legal system of mine environment management in China is concerned, the defects of the imperfect system are explored from the current situation of legislation and the present situation of related legal system. At the same time, by drawing lessons from the experiences of the United States and Australia in the field of mine environment management, the paper puts forward some suggestions for establishing the legal system of mine environment management in China. By perfecting the existing relevant laws and regulations, relying on advanced science and technology and institutional innovation, on the basis of adhering to the principle of cleaner production, adhering to the principle of "who benefits, who governs" in environmental law, and adhering to the principle of "development and protection simultaneously", In order to reduce the possibility of mine environmental problems occurring at the source, to construct a perfect legal system of mine environmental management, and to carry out the work of mine environmental management actively, and to effectively stop the further deterioration of mine environment, so as to realize the real population, Harmonious and sustainable development of resources and environment. It can be said that the establishment of the legal system of mine environmental management can not only make up for and perfect the environmental legal system of our country, but also provide a powerful legal guarantee for urging mining enterprises to carry out environmental protection.
