环境法视角下河长制的法律机制建构思考

【摘要】：以2016年《关于全面推行河长制的意见》出台为界线,我国河长制发展经历了从地方试点探索到中央顶层设计两个阶段。河长制作为一种制度创新并非凭空而生,而是存在诸多法律依据与制度支撑,是地方政府环境质量负责制的具体落实、环保问责制的典型体现、生态保护红线制度的底线限制的实质拓展以及水资源流域管理与区域管理的有机结合。从环境法角度审视,河长制也存在一些制度内生困境,应相应构建法律保障机制:河长制存在职非法定的困境,应构建长效法律机制;河长制与现行水资源管理体制存在抵牾之处,应构建二者协调机制体系;河长制考核问责制存在异化风险,应相应体系化设计考核问责机制。
[Abstract]:Taking "opinions on implementing River length system in an All-round way" in 2016 as the boundary, the development of river length system in China has experienced two stages from local pilot exploration to central top-level design. The production of river length as a kind of system innovation is not born out of thin air, but there are many legal basis and system support, it is the concrete implementation of the environmental quality responsibility system of the local government, the typical embodiment of the environmental protection accountability system. The essential expansion of the bottom line limit of ecological protection red line system and the organic combination of water resources basin management and regional management. From the point of view of environmental law, there are some endogenetic difficulties in river length system, and the corresponding legal protection mechanism should be constructed: the river length system has the dilemma of non-statutory duty, and the long-term legal mechanism should be constructed; There are contradictions between the river length system and the current water resources management system, so the coordination mechanism system between the two systems should be constructed, and the accountability system of river length system should be systematized to design the examination accountability mechanism.
