论我国环境立法的完善

【摘要】： 《中华人民共和国环境保护法》自1989年颁布以来,中国的社会经济发生了巨大的变化,经济建设迅猛发展,而环境却不断被破坏,新的环境问题不断涌现。虽然近几年环境保护的力度加强了,但环境遭污染、生态遭破坏的现象仍然突出,环境问题也日益严重。在依法治国、建设社会主义法治国家精神指导下的今天,《中华人民共和国环境保护法》及相关的环境与资源保护等方面的法律、法规面对着理论和现实两方面的压力,现有的环境立法已经不适应环境保护和经济发展的现实需要。环境社会关系的变化呼吁《环境保护法》的修改,也呼吁环境立法的进一步完善,这既是中国经济发展与人们生活的需要,也是中国的环境保护与国际接轨的需要。自环境法这一新兴的法学分支问世以来,学者们就给予了极大的关注。我国环境法的起步较晚,环境法在立法上并未转型,依然是环境污染防治法为核心的传统型环境法体系,而运用传统法手段保护环境已显示出极大的局限性,为此,有必要从一些新的理论出发,转变思想观念,逐步完善我国的环境立法。本文回顾了我国环境法律产生、发展的历史,从历史的角度和实证的方法,对现行环境法律进行了缺陷分析,同时认为,通过转变现行环境立法的指导思想,将经济调整机制引入环境立法,强化市场机制的作用,构建环境与资源市场法律制度体系,目的是在可持续发展思想的指导下,以科学发展观为统率,建立与完善环境资源产权制度,使市场机制对人们的行为能形成合理的激励,结合政府职能的转变,合理进行资源配置,将会促进环境立法的完善,引导人们合理地开发、利用、保护有限的资源及环境,从而建立起人与自然、人与人、人与社会和谐共处、良性循环、全面发展、持续繁荣为基本宗旨的生态文明社会。
[Abstract]:The environmental protection law of the People ' s Republic of China has changed greatly since the promulgation of the Law on Environmental Protection of the People ' s Republic of China since its promulgation in 1989 , and the environment has been destroyed . The environmental problems are becoming more and more serious . Although the environmental pollution has been strengthened in recent years , the environmental problems are becoming more and more serious . The changes of environmental social relations call for the revision of environmental protection law and the further improvement of environmental legislation . This is both the economic development and the needs of people ' s life , and the need of environmental protection and international connection in China .

Since the emergence of environmental law , scholars have paid great attention . The environmental law of our country has not been transformed in legislation , it is still the traditional environmental law system which is the core of environmental pollution control law , but it is necessary to change the concept of thought from some new theories and gradually perfect our environmental legislation .

This paper reviews the history of the generation and development of environmental law in our country , analyzes the existing environmental law from the historical perspective and the empirical method , and thinks that by changing the guiding ideology of the current environmental legislation , the economic adjustment mechanism is introduced into the environment legislation and the market mechanism is strengthened .
