【摘要】： 河流是有生命的。维持黄河健康生命既是黄河自身生存发展的需要,也是延续、发扬中华文明的需要,更是黄河流域社会经济可持续发展的基础性保障。大江大河的治理开发需要立法,黄河的治理开发更需要法律保障。本文从黄河基本河情出发,结合国外大江大河流域立法的理论与实践,全面分析了黄河立法的必要性、可行性,并从立法宗旨、结构、制度框架方面,对黄河法立法的框架结构和主要内容进行了详细勾勒。并围绕解决解决黄河防洪、水资源配置、水污染防治、水土流失治理和重要工程建设等方面的重大问题,在建立和完善流域管理与行政区域管理相结合的管理体制和运行机制,完善黄河防洪管理制度,建立和完善符合黄河实际的河道管理制度,建立黄河水资源按流域统一管理的制度,实施计划用水和节约用水制度,促进水资源的合理配置和节约利用；建立水土保持生态建设和河源、河口生态保护制度等方面提出了积极见解。结合黄河立法的法律属性,本文分析了黄河立法与水法律、水行政法规、水利部部门规章、地方性政府规章之间的关系,对黄河立法的效力层次、适用范围进行了界定,对立法中需要正确处理和把握的关键问题也进行了深入分析和探讨。
[Abstract]:Rivers are alive. To maintain the healthy life of the Yellow River is not only the need of survival and development of the Yellow River itself, but also the continuation. The need to carry forward the Chinese civilization is also the basic guarantee for the sustainable development of social economy in the Yellow River Basin. The regulation of the river needs legislation, and the Yellow River needs legal protection. Based on the basic river conditions of the Yellow River, combined with the theory and practice of the legislation of the Great River Basin abroad, this paper comprehensively analyzes the necessity and feasibility of the legislation of the Yellow River, and from the legislative purposes, structure, institutional framework, The frame structure and main contents of the legislation of the Yellow River Law are described in detail. In order to solve the major problems in flood control, water resources allocation, water pollution control, soil erosion control and important engineering construction of the Yellow River, the management system and operation mechanism of the combination of watershed management and administrative area management should be established and perfected. To improve the Yellow River flood control management system, to establish and perfect the river channel management system that conforms to the actual situation of the Yellow River, to establish a unified management system for the Yellow River water resources according to the river basin, and to implement the planned water use and water saving systems. It also puts forward some positive views on the establishment of ecological construction of soil and water conservation, river source and estuarine ecological protection system. Combined with the legal attribute of the Yellow River legislation, this paper analyzes the relationship between the legislation of the Yellow River and the water law, the water administrative regulations, the department regulations of the Ministry of Water Resources, the local government regulations, and defines the level of validity and the scope of application of the legislation of the Yellow River. The key issues that need to be handled and grasped in legislation are also analyzed and discussed in depth.
