【摘要】： 能源是人类社会存在与发展的物质基础,也是国民经济增长的根本动力。随着常规能源的日益枯竭以及大量使用化石能源带来的一系列环境问题,人类必须寻找可持续的能源发展道路。资源丰富、干净清洁、能够再生的可再生能源无疑是人类最行之有效的选择。作为可再生能源之一的生物质能源一直是人类赖以生存的重要能源,是仅次于煤炭、石油、和天然气而位居世界第四大能源,在整个能源系统中占有重要地位。法律制度是生物质能产业发展的重要保证。从国外经验来看,在产业建立和发展的初始阶段,法律在市场、财税、科研、投资等方面的保障是必要的。为促进我国生物质能产业持续发展,我国政府先后出台了一系列与之相关的法律、法规和政策措施。但就目前情况看,我国生物质能产业法律制度体系还不健全,还缺少相应的法律支撑和制度保障。因此,我们迫切需要加强对生物质能产业持续发展法律制度的完善,进一步规范生物质能产业的发展。本文选择从持续发展的角度来考量我国生物质能产业法律制度的完善,从宏观层面对我国生物质能产业法律制度进行整体架构,借助于能源学、生态学等学科的相关理论,运用实证分析、比较分析、归纳分析、系统分析等研究方法,解释为什么要完善我国生物质能产业法律制度,什么样的完善是适宜我国国情的,以及应当如何完善我国生物质能产业持续发展的法律制度。本文主体共分为四个部分展开论述。本文首先从我国生物质能发展形势及必要性分析入手。我国作为一个农业大国,生物质能源资源丰富,发展潜力巨大,在我国的能源结构体系中占有重要地位。持续的开发利用生物质能源,对缓解能源供需矛盾,保障能源安全,减轻环境压力,促进农村经济发展都具有重要意义。但是,生物质能源的开发利用又会对生态环境造成一定的负面效应：对水资源供应造成影响、威胁粮食供应安全、污染大气、破坏生物多样性等。因而,必须加强法律制度的保障和规制效应,发挥其积极作用,限制其消极作用。其次,从对我国现行生物质能法律制度的分析来考察其实施绩效,诊断其保障促进功能缺失的原因。我国生物质能源开发利用的法律制度较少,相关立法涉及的内容也非常有限,对于它的规定更多的是散见于部门规章等规范性文件中。法律中缺乏对生物质能发展的明确性规定,缺失生物质能产业发展的相关制度,这些都将影响我国生物质能产业持续发展进程。然而,国外生物质能发达国家的先进经验可以给我们一些借鉴和启示。因此,本文第三部分着重探讨了国外促进生物质能产业发展的立法经验。国外生物质能产业之所以发展迅猛,一个重要的原因是生物质能产业法律制度的建立和完善。在本部分中,笔者主要运用归纳分析和比较分析的方法对国外生物质能产业发展的法律制度进行归纳比较分析,为我国生物质能产业持续发展的法律制度保障提供可借鉴经验。最后,本文明确提出了完善我国生物质能产业立法的建议。在具体建议上,本文立足我国基本国情,在借鉴国外生物质能产业发达国家经验的基础上,明晰立法中生物质能法律保障制度的原则,并对我国生物质能立法的具体制度提出合理化建议。
[Abstract]:Energy is the material basis for the existence and development of human society as well as the fundamental motive force of the growth of the national economy. With the increasing depletion of the conventional energy and a series of environmental problems caused by the use of fossil energy, human beings must seek a sustainable energy development road. The resources are rich, clean and clean, renewable energy can be regenerated without doubt. As one of the most effective alternatives, biomass energy, as one of the renewable energy sources, has always been an important source of energy for human survival. It is the fourth largest energy source in the world and occupies an important position in the whole energy system, second only to coal, oil and natural gas.
The legal system is an important guarantee for the development of the bio energy industry. From the foreign experience, in the initial stage of the establishment and development of the industry, the protection of the law in the aspects of market, finance and taxation, scientific research and investment is necessary. In order to promote the sustainable development of the Bioenergy Industry in China, our government has issued a series of related laws, regulations and the relevant laws and regulations. However, as far as the current situation is concerned, the legal system system of our country's Bioenergy Industry is still not sound, and there is no corresponding legal support and system guarantee. Therefore, we urgently need to strengthen the improvement of the legal system of the sustainable development of the biomass industry and further standardize the development of biomass energy industry.
This article selects from the perspective of sustainable development to examine the perfection of the legal system of the Bioenergy Industry in China, and from the macro level to the overall framework of the legal system of the biomass energy industry in China, with the help of the related theories of energy science and ecology, and the use of empirical analysis, comparative analysis, induction and analysis, system analysis and other research methods. What to perfect the legal system of our country's biomass energy industry, what kind of perfection is suitable for our national conditions, and how to perfect the legal system of the sustainable development of our country's biomass energy industry.
The main body of this article is divided into four parts.
Starting with the analysis of the development situation and necessity of biomass energy in China, China, as a large agricultural country, has rich biomass energy resources and great potential for development, and occupies an important position in the energy structure system of our country. The sustainable development and utilization of biomass energy is a kind of sustainable development and utilization of energy, to alleviate the contradiction of energy supply and demand, to ensure energy security and to reduce environmental pressure. It is of great significance to promote the development of the rural economy. However, the development and utilization of biomass energy will cause some negative effects on the ecological environment, which will affect the supply of water resources, threaten the security of grain supply, pollute the atmosphere, and destroy the biological diversity. Therefore, it is necessary to strengthen the protection and regulation effect of the legal system and bring into play its effect. The positive effect is to limit its negative effect.
Secondly, from the analysis of the current legal system of biomass energy in China to investigate the performance of its implementation and to diagnose the reasons for its lack of function, the legal system for the development and utilization of biomass energy in China is less, and the relevant legislation is very limited, and more of its provisions are in the normative documents, such as department rules and regulations. There is a lack of clear regulations on the development of biomass energy in the law, and the lack of relevant systems for the development of the biomass energy industry, which will all affect the sustainable development process of our country's biomass energy industry.
However, the advanced experience of foreign biomass developed countries can give us some reference and enlightenment. Therefore, the third part of this article focuses on the legislative experience of promoting the development of the biomass energy industry abroad. The reason why the foreign biomass energy industry is developing rapidly is an important reason for the establishment and improvement of the legal system of the biomass energy industry. In this part, the author mainly uses the method of inductive analysis and comparative analysis to compare and analyze the legal system of the development of foreign biomass energy industry, which can provide reference experience for the legal system of the sustainable development of the Bioenergy Industry in China.
Finally, this paper puts forward some suggestions to improve the legislation of the biomass energy industry in our country. On the basis of the basic national conditions of our country, this article clarifies the principle of the legal guarantee system of the biomass energy in the legislation on the basis of the experience of the developed countries of the foreign biomass energy industry, and puts forward the specific system of the legislation of our country's biomass energy.
