大用户直购电法律问题研究

【摘要】： 大用户直购电,是我国进行电力体制改革的重点和难点之一。勿庸置疑,推行大用户直购电可以促进供需直接见面,进一步挖掘电力市场潜力,提高市场效率,是促进电力体制改革的有益尝试,实践证明,用户直购电是电力市场建设的必经阶段。随着我国社会主义市场经济的快速发展,电力体制改革和电力市场建设的逐步深入,加之电力供需形势缓和,开展用户(首先是大用户)直购电的时机、条件逐渐成熟。开展大用户直购电已成为我国电力市场改革进程中一道不能绕开、亟待跨越的坎。目前,国内大用户直购电的试点工作正在逐步推进中,从试点的情况可以看出,大用户直购电在打破电力垄断、促进电力供应集成交易、节约电能成本、提高企业效益等方面表现非常突出。然而,不容回避的是,由于中国电力运营体制尚存在不够完善的地方,比如在电力运营准入制度、输配电价定价机制、电力监管、电力合同权益关系等方面的规定还不够细致,使大用户直购电制度陷入一种尴尬的局面。一方面,从合理性的角度来看,大用户直购电制度给用电企业与发电企业提供了更大的自主选择权,间接地促进了电力市场的良性发展,而另一方面,由于电力立法的相对滞后,大用户直购电在实施过程中不但没有要可依据的法律支撑,在某些方面甚至还与现行法相冲突,这给大用户直购电制度的推行带来很大障碍。因此,要想使大用户直购电制度的制度优势得以发挥,首先就要为大用户直购电制度扫除障碍,不但要从电力体制上对售电侧的管制松绑,也要在现行相关法律中对大用户直购电制度的交易模式加以规定,明确大用户直购电交易过程中的权利与义务,提高大用户直购电交易的规范性、可预测性。
[Abstract]:The direct purchase of electricity by large users is one of the key and difficult points in the reform of the power system in China. No doubt, the implementation of the direct purchase of large users can promote direct meeting of supply and demand, further excavate the potential of the electricity market and improve the efficiency of the market. It is a useful attempt to promote the reform of the power system. The practice has proved that the direct purchase of electricity by the users is a must for the construction of the electricity market. With the rapid development of our socialist market economy, the reform of the power system and the gradual deepening of the power market construction, and the relaxation of the power supply and demand situation, the opportunity for the direct purchase of electricity by the users (first of all the large users) is gradually mature. At present, the pilot work of direct power purchase by large domestic users is being progressively promoted. From the pilot situation, it can be seen that the direct purchase of electricity from large users is very important in breaking the power monopoly, promoting the integration of electricity supply, saving the cost of electricity, and improving the efficiency of the enterprise. However, it is not unavoidable that the power of China is due to the power of China. The operation system is still not perfect, for example, in the power operation access system, the pricing mechanism of the transmission and distribution price, the power regulation, the rights and interests of the power contract, and so on, it is not careful enough to make the large user direct purchase system into an embarrassing situation. On the one hand, from a reasonable point of view, the large users direct power purchase system to the power supply. Enterprises and power generation enterprises have provided greater independent choice, which indirectly promotes the benign development of the electricity market. On the other hand, due to the relative lag of power legislation, the direct purchase of electricity by large users has not only a legal support to be based on in the implementation process, but in some respects it is still in conflict with the current law. This gives the large users direct purchase of electricity. The implementation of the system has brought great obstacles. In order to give full play to the institutional advantages of the direct power purchase system of the large users, it is necessary to remove the obstacles to the direct purchase system of the large users, not only from the control of the electric power system, but also in the current relevant laws. The rights and obligations of large users in direct purchase transactions are greatly improved, and the normalization and predictability of large consumer direct purchase transactions are enhanced.
