【摘要】： 环境权是环境法的核心与根本,也是环境立法、执法和环境诉讼的基础。环境权理论主要包括环境权主体、内容和客体三个方面,其中环境权主体在整个环境权理论中起决定作用。随着环境权研究的深入,环境权主体成了理论界研究的热点,其争论的核心是主体的确认问题。本文从环境权的提出入手,在总结环境权的特点、分析环境权主体的性质和其与周围环境要素关系的基础上,认为环境权主体的研究应该集中在环境权主体的权利上,而不是集中在环境权主体的确认上。环境权既是权利与义务的统一,又是自益与共益的统一,环境权的这种特殊性决定了环境权主体权利的特殊性,即“环境权主体不同,权利不同”。在此基础上本文对国家、公民、法人及其他组织、人类的环境权利作了详细研究,认为国家的环境权利有:环境管理权,环境监督权,特定条件下的环境使用权,以及保护、改善、治理环境的义务和履行国际义务;公民的环境权利有:环境使用、利用权,环境状况知情权,环境事务参与权,环境请求权,以及合理使用、利用环境资源的义务和保护、改善环境的义务;法人及其他组织的环境权利有:环境利用、开发(使用)权,排污权,请求处理权,以及节约和合理使用、利用环境资源的义务,保护、改善环境及防治污染与破坏环境的义务;人类的环境权利有:平等使用、利用共同财产权,合理开发、利用的义务以及保护、改善环境与合作的义务。另外,本文对每类环境权主体所享有的每项环境权利具体又包括哪些方面进行了详细的探讨,也对某些相似的环境权利与环境义务作了尝试性区分。
[Abstract]:Environmental right is the core and foundation of environmental law, as well as the foundation of environmental legislation, enforcement and environmental litigation. The theory of environmental right mainly includes three aspects: subject, content and object of environmental right, in which the subject of environmental right plays a decisive role in the whole theory of environmental right. With the deepening of the research on environmental rights, the subject of environmental rights has become a hot topic in the theoretical circle. The core of the debate is the confirmation of the subject. Based on the analysis of the nature of environmental rights and the relationship between them and the surrounding environmental elements, the author thinks that the research of environmental rights should focus on the rights of environmental rights. It is not concentrated on the confirmation of the subject of environmental right. Environmental right is not only the unity of rights and obligations, but also the unity of self-benefit and common benefit. This particularity of environmental right determines the particularity of environmental right subject, that is, "environmental right subject is different, right is different". On this basis, this paper makes a detailed study of the environmental rights of the state, citizens, legal persons and other organizations, and human beings. It is concluded that the environmental rights of the country are: the right to environmental management, the right to supervise the environment, the right to use the environment under certain conditions, and the protection of the environment. Environmental rights of citizens are: environmental use, right to know about the state of the environment, right to participate in environmental affairs, right to environmental claims, and reasonable use, The obligation to use and protect environmental resources and the obligation to improve the environment; the environmental rights of legal persons and other organizations are: environmental use, development (use) rights, emission rights, claims for disposal, and conservation and rational use, The obligation to use environmental resources, to protect, to improve the environment and to prevent pollution and damage to the environment; human environmental rights include the equal use, the use of common property rights, the obligation to exploit reasonably, and the obligation to use, as well as to protect, Duty to improve the environment and cooperation In addition, this paper makes a detailed discussion on the specific aspects of each environmental right enjoyed by the subject of each kind of environmental rights, and makes a tentative distinction between some similar environmental rights and environmental obligations.
