【摘要】：安全的饮用水是广大人民群众身体健康和生命安全的重要保障,是关乎国计民生的重要公共资源,尤其是在我国经济快速发展与人民生活质量日益提高的今天,关系人民切身利益的饮用水安全状况令人堪忧。本文从法学角度对饮用水安全问题进行研究,本研究在理论上将有利于深化对饮用水安全理论问题的研究和完善饮用水安全的法律体系,在实践上将有利于改善我国饮用水安全的现状,进而提高人民群众的生活质量。本文通过对国内外饮用水安全的理论研究现状的阐述,提出了饮用水安全问题研究的目的及意义。对饮用水及饮用水安全的定义进行明确的界定,概括性的阐述了我国饮用水水量不足,水质污染严重、预警和应急能力不足的现状,并说明了保障我国饮用水安全的重要意义。通过对饮用水安全的法律保护现状的详细分析,提出我国饮用水安全法律保护存在的立法、法律制度、法律意识及法律责任上的问题,在借鉴美国、日本、俄罗斯、中东和北非等国外饮用水安全立法及管理制度经验的基础上,总结出完善我国饮用水安全的法律保护措施：首先应尽快制定专门的《饮用水安全法》,并明确了《饮用水安全法》的指导思想,即可持续发展理论和科学发展观,详细论述了立法的基本原则,然后从饮用水安全的法律制度、法律意识、法律责任等角度提出了具体的建议。
[Abstract]:Safe drinking water is an important guarantee for the health and safety of the people, and an important public resource related to the national economy and the people's livelihood, especially today, when China's economy is developing rapidly and the people's quality of life is improving day by day. The safety of drinking water, which concerns the vital interests of the people, is worrying. In this paper, the problem of drinking water safety is studied from the angle of law. This study will be helpful to deepen the theoretical research on the safety of drinking water and perfect the legal system of drinking water safety. In practice, the present situation of drinking water safety in China will be improved, and the quality of life of the people will be improved. In this paper, the purpose and significance of the study on drinking water safety are put forward by expounding the present situation of theoretical research on drinking water safety at home and abroad. The definition of drinking water and drinking water safety is clearly defined, and the status quo of drinking water quantity shortage, serious water pollution, early warning and emergency response capacity in our country is described in a general way, and the importance of ensuring drinking water safety in our country is also explained. Through the detailed analysis of the present situation of the legal protection of drinking water safety, this paper puts forward the problems in the legislation, legal system, legal consciousness and legal liability of the legal protection of drinking water safety in China, drawing lessons from the United States, Japan and Russia. Based on the experience of drinking water safety legislation and regulatory systems abroad in the Middle East and North Africa, The legal protection measures to perfect the drinking water safety in our country are summarized. Firstly, the special drinking water safety law should be formulated as soon as possible, and the guiding ideology of the drinking water safety law is defined, that is, the theory of sustainable development and the scientific development view. This paper discusses in detail the basic principles of legislation, and then puts forward some concrete suggestions from the aspects of the legal system, legal consciousness and legal liability of drinking water safety.
