兰州市大气污染防治的法律对策研究

【摘要】： 大气是人类和其它生物赖以生存和发展的基本环境要素,大气环境资源的破坏是一种不可逆的过程。近年来,随着兰州地区经济社会的迅速发展,兰州市空气污染问题凸现,污染日趋严重,已经影响到了经济、社会发展和市民的生活。兰州市大气污染严重的原因除了地形气候、工业和能源结构不合理、冬季取暖燃煤、汽车尾气等原因外,还与缺乏专门的大气污染防治的法律法规,以及不能严格执法、监督管理有关。考察国外大气污染防治的经验,一些发达国家非常重视利用法律手段保护大气环境,它们通常颁布具体的、可操作性强的法律法规对保护大气的具体手段做出明确规定,并注重运用经济手段防治大气污染,这些有益的做法对预防和治理兰州市大气污染具有一定参考借鉴。本文在剖析现行与大气保护相关的法律法规所存在的问题的基础上,结合国内外预防和治理大气污染的经验,尤其针对兰州市大气污染的特殊性,对其污染现状和原因进行了具体分析,提出了兰州市大气污染防治的一系列制度、措施和法律对策,即通过加强有关立法,强化环境影响评价标准,污染物排放总量控制和环境目标责任制等环境管理制度,建立大气污染防治与经济协调发展机制,对大气污染的治理给予更大的资金支持,鼓励公众的参与,通过一系列配套性的完善措施,以期强化大气污染防治,为市民营造良好的人居环境,促进资源节约型、环境友好型城市建设,努力实现兰州经济、社会和环境的协调发展。
[Abstract]:The atmosphere is the basic environmental factor for the survival and development of human beings and other living things. The destruction of atmospheric environmental resources is an irreversible process. In recent years, with the rapid development of the economy and society in Lanzhou, the air pollution problem in Lanzhou City has become more and more serious, which has affected the economic, social development and the life of the citizens. The reasons for the serious air pollution in Lanzhou are not only topography and climate, unreasonable industrial and energy structure, heating and burning coal in winter, automobile exhaust and other reasons, but also the lack of special laws and regulations for the prevention and control of air pollution, and the lack of strict enforcement of the law. Supervision and management are relevant. Reviewing the experience of foreign countries in the prevention and control of air pollution, some developed countries attach great importance to the use of legal means to protect the atmospheric environment. They usually issue specific and operable laws and regulations that clearly stipulate the specific means of protecting the atmosphere. It also pays attention to the use of economic means to prevent and control air pollution. These beneficial measures have some reference for preventing and controlling air pollution in Lanzhou. On the basis of analyzing the problems existing in the existing laws and regulations related to atmospheric protection, this paper combines the experience of preventing and controlling air pollution at home and abroad, especially in the light of the particularity of air pollution in Lanzhou. This paper analyzes the present situation and causes of air pollution in Lanzhou City, and puts forward a series of systems, measures and legal countermeasures for the prevention and control of air pollution in Lanzhou City, that is, by strengthening the relevant legislation and strengthening the standards of environmental impact assessment, Environmental management systems such as total pollutant discharge control and environmental target responsibility system, the establishment of a coordinated mechanism for the prevention and control of air pollution and the coordinated development of the economy, greater financial support for the control of air pollution, and encouragement of public participation, Through a series of complete measures to strengthen the prevention and control of air pollution, to create a good living environment for the citizens, to promote the construction of resource-saving and environment-friendly cities, and to achieve the coordinated development of Lanzhou's economy, society and environment.
