海域物权法律制度研究

【摘要】： 海域作为一种重要的自然资源对国家和社会的可持续发展起到不可忽视的作用。自90年代以来,各种新型海洋产业迅速发展。伴随着海域开发的不断深入,有关海域使用的问题日益突出,学界对海域物权特别是对海域使用权的研究也越来越多。2002年我国开始实施《海域使用管理法》,该法的颁布实施标志着我国已经开始建立海域物权法律体系。但是,在现行的海域物权法律制度中还存在着很多不足。本文结合民法物权的基础理论,以海域的法律属性作为出发点,结合海域利用的目的和方式,重点对海域使用权进行详细的论述,进一步提出了对《海域使用管理法》的一些修改完善意见,并对海域使用权的法律适用以及更好的与其他相关法律协调进行论述。本文除绪论和结语,正文由三个部分组成: 第一章海域物权法律制度的基本问题。主要介绍海域物权的客体——海域的基本概念和基本特征,并进一步界定了海域物权客体的范围。从物权客体理论的新视角阐述了海域作为“物”的特性。第二章中外海域物权法律制度概览。介绍主要沿海国家(美国、英国、法国、意大利、韩国、日本)海域物权法律制度以及我国的海域物权法律制度的发展,将我国海域物权法律制度的发展分为萌芽、起步以及基本建立三个阶段。第三章我国海域物权法律制度现状及立法完善。主要对海域所有权以及海域使用权的一些具体制度进行阐述。首先对海域使用权的母权——海域所有权进行了具体的分析,这是研究海域使用权的前提,提出了海域所有权应由专门的机关来行使。然后对海域使用权的法律性质进行了界定,先明确它是私权,并介绍了私权说中的诸多学说,分析了各学说的优、缺点。将海域使用权定性为用益物权,但兼具公、私权的特殊性质。接着对海域使用权的设定、变更和终止的问题进行了论述,提出了存在的问题。最后,提出了我国《海域使用管理法》的不足及完善,对现行的法律制度提出了一些完善的建议。例如,在分析海域使用权与其他相关权利的协调中关于海域使用权与渔业权的协调,提出了将渔业权分解为捕捞权和养殖权分别调整的建议。
[Abstract]:As an important natural resource, sea area plays an important role in the sustainable development of our country and society. Since the 1990 s, various new marine industries have developed rapidly. With the continuous development of the sea area, the problems related to the use of the sea area become increasingly prominent. In 2002, China began to implement the Law on the Management of Sea area use, and the promulgation and implementation of this Law indicates that China has begun to establish a legal system of real right in the sea area. However, there are still many deficiencies in the current legal system of real right in the sea area. Based on the basic theory of real right of civil law, this paper takes the legal attribute of sea area as the starting point, combined with the purpose and method of sea area utilization, and discusses in detail the right to use the sea area. Further, the author puts forward some suggestions on the revision and perfection of the Law on the Administration of Sea area use, and discusses the application of the law of the right to use the sea area and better coordination with other relevant laws. In addition to the introduction and conclusion, the text is composed of three parts: the first chapter is the basic problems of the legal system of maritime real right. This paper mainly introduces the basic concept and characteristics of the object of the real right of sea area, and further defines the scope of the object of the real right of the sea area. This paper expounds the characteristics of sea area as "object" from a new angle of view of object theory of real right. Chapter II Overview of the legal system of real right in Chinese and foreign sea areas. This paper introduces the legal system of real right in the sea area of the main coastal countries (United States, England, France, Italy, South Korea, Japan) and the development of the legal system of real right in our country, and divides the development of the legal system of real right in our country into germination. Start and establish basically three stages. The third chapter is about the present situation and legislative perfection of the legal system of real right of sea area in our country. Mainly to the sea area ownership and the sea area use right some concrete system carries on the elaboration. Firstly, the author makes a concrete analysis of the ownership of the sea area, which is the premise of studying the right to use the sea area, and puts forward that the ownership of the sea area should be exercised by a special organ. Then it defines the legal nature of the right to use the sea area, first defines it as a private right, introduces many theories in the theory of private rights, and analyzes the advantages and disadvantages of each theory. The right to use sea area is defined as usufruct right, but it has the special nature of public and private rights. Then, the establishment, change and termination of the right to use the sea area are discussed, and the existing problems are put forward. Finally, the paper puts forward the deficiency and perfection of the Law of Sea area use Management in our country, and puts forward some perfect suggestions to the current legal system. For example, in the analysis of the coordination between the right to use the sea area and other related rights, the paper puts forward the suggestion that the fishery right should be decomposed into the right of fishing and the right of aquaculture respectively in the coordination of the right of use of the sea area and the right of fishery.
