【摘要】: 环境保护必须谋求科学化、法制化的途径,而环境影响评价则是环境保护的重要手段和措施,建立科学的环境影响评价制度,,是改善人类生存现状和获得良好环境质量的保障。1979年我国《环境保护法(试行)》首次把建设项目环境影响评价作为法律制度确立下来,到2002年颁布《中华人民共和国环境影响评价法》,标志着我国由法律、专门的法规和部门规章组成的环境影响评价法律制度的日趋完善。 当前世界各国都着力于环境影响评价制度的建设,我国环境影响评价制度建设已经取得了一定成绩,但尚存在着许多问题。本文从可持续发展影响下的环境影响评价理论入手,介绍了环境影响评价的概念、性质,论述了我国环境影响评价法律制度的立法目的、环境影响评价法律制度的法律依据,并结合我国刚颁布的《中华人民共和国环境影响评价法》介绍了我国环境影响评价法律制度的具体法律规定。针对我国环境影响评价过程中公众参与的缺失,本文专章论述了我国环境影响评价法律制度中公众参与的界定、理论基础及作用,分析了我国环境影响评价法律制度中公众参与的法律依据及法律安排,并参考借鉴外国环境影响评价公众参与的先进理念及其具体法律规定,指出当前我国环境影响评价公众参与制度的最大缺失就是缺乏完善的环境影响评价公益诉讼制度。 最后,本文在参考借鉴环境影响评价先进发达国家在立法理论、具体操作制度的基础上,结合我国环境影响评价法律制度的立法现状及二十几年的实践,重点详细地分析研究了我国环境影响评价法律制度在理论、立法及具体操作层面上的问题与不足,进而提出相应的对策,以期进一步完善我国的环境影响评价法律制度,更好的保障我国可持续发展战略的实施。
[Abstract]:Environmental protection must seek a scientific and legalized approach, and environmental impact assessment (EIA) is an important means and measure of environmental protection. It is the first time that the environmental impact assessment of construction projects has been established as a legal system in 1979. The promulgation of the Environmental impact Assessment Law of the people's Republic of China in 2002 marks the improvement of the legal system of environmental impact assessment in China, which is composed of laws, special regulations and departmental regulations. At present, all the countries in the world are focusing on the construction of environmental impact assessment system. The construction of environmental impact assessment system in China has made some achievements, but there are still many problems. This paper begins with the theory of environmental impact assessment under the influence of sustainable development, introduces the concept and nature of environmental impact assessment, discusses the legislative purpose of the legal system of environmental impact assessment in China and the legal basis of the legal system of environmental impact assessment. Combined with the "Environmental impact Assessment Law of the people's Republic of China" recently promulgated in China, the specific legal provisions of the legal system of environmental impact assessment in China are introduced. In view of the lack of public participation in the process of environmental impact assessment in China, this paper discusses the definition, theoretical basis and function of public participation in the legal system of environmental impact assessment in China. This paper analyzes the legal basis and legal arrangement of public participation in the legal system of environmental impact assessment in China, and refers to the advanced concepts and specific legal provisions of public participation in environmental impact assessment in foreign countries. It is pointed out that the greatest deficiency of the public participation system of environmental impact assessment in China is the lack of perfect public interest litigation system of environmental impact assessment. Finally, on the basis of the legislative theory and the concrete operating system of the advanced developed countries of environmental impact assessment, this paper combines the current legislative situation and the practice of the legal system of environmental impact assessment in our country for more than 20 years. The problems and deficiencies in the theory, legislation and concrete operation of the legal system of environmental impact assessment in China are analyzed and studied in detail, and the corresponding countermeasures are put forward in order to further improve the legal system of environmental impact assessment in China. Better ensure the implementation of our country's sustainable development strategy.
