论水权的法律性质及其制度构造

【摘要】：水权是在水资源特许使用中经过特许而设定的权利,特许使用权人即水权人可继续、且排他性地占有特定水资源。水权本质上属于特许权的一种,从实然层面考察,我国法律上只创设了取水权这一种水权,但是从应然层面分析,我国法律还应创设养殖权和具有特许权属性的捕捞权,并将之纳入到水法的调整范围之中。水权是水资源所有权通过公物管理权的作用所发生的公法性法律效果的权利,且因水权具有不同于私法物权的特征决定了水权具有明确的公法属性,为公法上的公物特许使用权。作为公法上的权利,只能从公法的角度运用公法的理论去理解和构建水权制度。在公法权利的基础上,我国立法上应建立以“输水系统的输水能力”为主,“合理的有益用水”为辅的水权配置标准,并在此标准上引入市场化的配置方式合理高效配置水资源;建立以交易申报制度为原则,以交易审批制度为例外的公法规制制度,并辅以其他制度的设计,完善对水权交易的公法规制;建立三阶段的水权公法保护体系,从水权创立前、创立中以及创立后,全方位多角度的加强对水权的公法保护。
[Abstract]:Water right is the right established by concession in the use of water resources. The franchisor, that is, the water right holder, can continue and occupy the specific water resources exclusively. Water right is essentially a kind of concession. From the perspective of reality, only the right to water is created in our law. However, from the perspective of necessity, the law of our country should also create the right to breed and the fishing right with the attributes of concession. And bring it into the adjustment scope of water law. Water right is the right of public law effect of water resources ownership through the function of public property management, and the water right has a clear public law attribute because of its characteristics different from private law property right. The right to use public property in public law. As a right in public law, we can only use the theory of public law to understand and construct the water right system. On the basis of the right of public law, the allocation standard of water right should be established in our country, which is mainly "the capacity of water conveyance system" and "reasonable beneficial water". On the basis of this standard, the reasonable and efficient allocation of water resources is introduced into the market-oriented allocation mode, and the public law regulation system, which takes the transaction declaration system as the principle and the transaction examination and approval system as the exception, is established and supplemented by the design of other systems. To perfect the public law regulation of water right transaction, to establish a three-stage public law protection system of water right, and to strengthen the public law protection of water right from all directions and angles before, during and after the establishment of water right.
