农村资源开发区域法制保障的制度理性

【摘要】：资源开发引起的农村环境问题不容乐观,制度理性的价值在于保障制度有序构建并有效运行。影响制度理性的三对因子是末端治理与风险预防、市场激励与政府管制、国家治理和民众互助。以三对关系的分立与契合为研究出发点,可以得出农村资源开发区域法制保障的制度理性:以风险预防为统领、以政府管制和市场激励为两翼及政府管制和市场激励下的民众互助为推动。
[Abstract]:The problem of rural environment caused by resource exploitation is not optimistic. The value of institutional rationality lies in ensuring the orderly construction and effective operation of system. The three pairs of factors affecting institutional rationality are terminal governance and risk prevention, market incentives and government regulation, national governance and mutual assistance. Taking the separation and correspondence of three pairs of relations as the starting point of the research, we can get the institutional rationality of the regional legal system guarantee for the development of rural resources: taking risk prevention as the leading factor, Government regulation and market incentives as the two wings and government regulation and market incentives under the popular mutual help for the promotion.
