西部农业生态修复与改善法治基本原则探析

【摘要】：改革开放以来,我国西部农业得到了快速发展,取得了巨大成就。西部地区粮食产量,占全国粮食总产量比重越来越大,对整个西部地区甚至整个国家经济都具有举足轻重的作用。但由于长期不合理的土地利用和自然灾害的不断影响,我国西部地区农业的自然生态环境破坏严重,生态环境恶化的趋势加快,严重制约了农业的增产、农民的增收,影响着西部农业经济的发展,也将威胁到整个国家的生态安全。农业生态修复与改善,形势所逼,刻不容缓,迫切呼唤完善相应的法律法规,健全农业生态修复与改善的法律机制。要建立、健全西部农业生态修复与改善法治体系,必须先确定其基本原则,并以此作为指导,制定相关具体法律法规。本文以确立西部农业生态修复与改善法治基本原则的内涵着手,论述了确立相关基本原则的必要性和意义所在；在对国内外相关研究介绍之后,指出我国农业生态修复与改善法治基本原则存在的问题及发展趋势,进而提出确立西部农业生态修复与改善法治的基本原则的路径选择；最后得出我国西部农业生态修复与改善法治建设应遵循的基本原则。文章在结构上分为六个部分。第一部分重点论述了本文的研究目的和研究意义,从法律原则的法理内涵着手,结合西部农业生态破坏的现状和区域农业特殊性的要求,以我国现有农业生态修复与改善法治为根基,指出确立西部农业生态修复与改善的法治基本原则的必要性,进而得出该原则确立的两大意义：一是有利于促进西部农业修复与改善法规的完善；二是有利于促进西部农业生态与经济的协调发展。第二部分主要是对国外相关研究进行了介绍和总结,选择了较有代表性的美国、俄罗斯和日本,并涉及到其他国家和地区的一些情况,总结出他们之间的相似特点和共通之处,为本文得出结论提供借鉴和参考。第三部分主要是从我国农业生态修复与改善法治的研究现状着手,汲取国内学者的精华,总结不足之处,进而得出我国农业生态修复与改善法治基本原则发展的四大趋势：从人类中心主义伦理观到生态伦理观的转变；从传统发展观到可持续发展观转变；从传统消费方式到可持续消费的转变；从生化经济到生态经济的转变。第四部分是在国内外研究现状和我国农业生态修复与改善法治基本原则发展趋势的基础上,结合西部农业生态环境的特殊性,得出确立西部农业生态修复与改善法治基本原则的总体思路,主要包括：以可持续发展观为指导；以农业循环经济为核心；以农业生态修复技术为出发点和以构建和谐新农村为目标。第五部分结合西部农业的可持续发展及生态修复与改善法治的特殊性,得出本文的研究成果,即我国西部农业生态修复与改善法制建设应遵循的基本原则。笔者提出六条基本原则,即：“预防为主”、“合理开发利用”、“生态责任”、“生态民主”、“协同合作”、“协调发展”。本文参考了国内外相关研究的理论成果和西部农业地区生态修复与改善的实际经验,通过定性分析法、文献研究法、经验总结法、对比分析法、跨学科研究法等方法,从观念和制度层面上,提出了以人为本、可持续发展的生态修复与改善理念,初步建立了西部农业生态修复与改善法治基本原则体系的设想,对我国当前西部地区农业生态修复与改善具有一定的积极意义,亦期对相关的研究产生积极的影响。研究结果表明：西部农业生态修复与改善法治基本原则的确立,须以科学发展观为指导,遵照和谐新农村和可持续发展观的要求,结合西部农业生态破坏的实际和生态系统自身修复与改善的规律来进行,以人为本、追求人与自然的和谐发展是其生命力所在。必须注意的是任何原则的提出必须扩充到相关法律的各个方面,才能真正做到贯彻和落实。这既离不开相关法律制度的立法研究,更离不开规范执法者的实际操作,人民群众的参与也是不容忽视的。总之,确立西部农业生态修复与改善的基本原则,完善相关法律法规制度,建立有效西部农业生态修复与改善法律机制,对推动西部农业的可持续发展和农业生态系统的良性循环都具有重要而深远的意义。
[Abstract]:Since the reform and opening - up , China ' s western agriculture has been rapidly developing and has made great achievements . The grain output in the western region has played an important role in the whole country and even the whole country . However , due to the unreasonable long - term unreasonable land use and natural disasters , the ecological security of the whole country is severely restricted .
After the introduction of relevant research at home and abroad , it points out the problems and developing trend of the basic principles of agricultural ecological restoration and improvement of the rule of law in our country , and then puts forward the path choice of establishing the basic principles of ecological restoration and improvement of the rule of law in the West ;
Finally , it is concluded that the basic principles of agricultural ecological restoration and improvement of rule of law in western China should be followed .

This article is divided into six parts . The first part focuses on the research purpose and the research significance of this paper . From the legal connotation of the legal principle , the paper points out the necessity of establishing the basic principle of the rule of law in the ecological restoration and improvement of agriculture in the West , and points out the two important meanings of the establishment of the principle : First , it is beneficial to promote the improvement of the agriculture in the West and the improvement of laws and regulations ;
The second part is to introduce and summarize the relevant studies abroad , select the more representative United States , Russia and Japan , and deal with some situations in other countries and regions , summarize the similarities and similarities between them , draw lessons from the essence of domestic scholars , summarize the shortcomings , and then draw up the four main trends in the development of the basic principles of agricultural ecological restoration and improvement of the rule of law : from the ethics of human centralism to the transformation of ecological ethics ;
From the traditional development view to the transformation of sustainable development view ;
Change from traditional consumption pattern to sustainable consumption ;
The fourth part is based on the research situation at home and abroad and the development trend of agricultural ecological restoration and the improvement of the rule of law basic principle .
Take the agricultural circular economy as the core ;
The fifth part combines the sustainable development of western agriculture and the particularity of ecological restoration and the improvement of the rule of law . The fifth part brings forward the research results of this paper , namely , the basic principle that the agricultural ecological restoration and the improvement of the legal system should be followed in our country . The author puts forward six basic principles , namely , " Prevention First " , " Rational Exploitation and Utilization " , " Ecological Responsibility " , " Ecological Democracy " , " Cooperative Cooperation " and " Harmonious Development " .

This paper , with reference to the theoretical results of relevant research at home and abroad and the practical experience of ecological restoration and improvement in western agriculture area , puts forward the idea of human - oriented and sustainable development based on qualitative analysis method , literature research method , experience summary method , comparative analysis method and interdisciplinary research method .

In short , establishing the basic principles of ecological restoration and improvement in the west , perfecting the relevant laws and regulations system , establishing effective western agricultural ecological restoration and improving legal mechanism , has important and far - reaching significance for promoting the sustainable development of western agriculture and the virtuous circle of agricultural ecosystem .
