论后现代主义哲学下环境法学研究方法

【摘要】： 环境法学研究方法是环境法学研究中的先导性因素,对环境法学研究方法进行研究,对于指导环境法学理论框架的确立,推动环境法学研究的深化,意义重大。同时,后现代主义哲学的兴起,使得当代法学家们对以往法学反思,试图超越自然法学和实证法学,致力于寻找综合、多元的法学研究方法。所以在后现代主义哲学背景下研究环境法学研究方法具有重要意义。目前传统法学理论下环境法学研究方法面临诸多困境。环境法学界对环境法学的某些基础理论争鸣不断,加之环境法学哲学基础缺失,使得环境法学研究方法处于混沌状态。同时,对“主客二分”法理解片面,传统环境法学研究方法对推动环境法学研究的深入存在局限。环境法学研究方法面临的困境,最重要一点便是环境法学哲学基础的缺失,它极需一种新的世界观作为理论支持。因此,以建构性后现代主义哲学为基础,研究环境法学研究方法,可为其变革寻得出路。在引入生态整体观、对“主客一体”提供新的思维方式的前提下,结合环境法学的学科特点,在环境法学研究方法体系中纳入整体分析方法和生态学研究方法,同时继承传统法学的研究方法,克服其局限性,推动环境法学的研究方法向开放化、多元化方向发展。
[Abstract]:The research method of environmental law is a leading factor in the study of environmental law. It is of great significance to study the research method of environmental law for guiding the establishment of the theoretical framework of environmental law and promoting the deepening of environmental law research. At the same time, the rise of postmodernist philosophy makes the contemporary jurists reflect on the past jurisprudence, try to surpass the natural law and empirical law, and devote themselves to seeking comprehensive and pluralistic legal research methods. Therefore, it is of great significance to study the research method of environmental law under the background of postmodernism philosophy. At present, the research methods of environmental law under the traditional law theory are facing many difficulties. The controversy of some basic theories of environmental law in the field of environmental law, coupled with the lack of philosophical basis of environmental law, makes the research method of environmental law in a state of chaos. At the same time, the understanding of "subjective and objective dichotomy" is one-sided, and the traditional research method of environmental law is limited to promote the research of environmental law. The most important point is the lack of philosophical foundation of environmental law, which needs a new world outlook as theoretical support. Therefore, on the basis of constructive postmodernism philosophy, the research method of environmental law can find a way out for its reform. On the premise of introducing the ecological holistic view and providing a new way of thinking to the "subject and object", and combining the characteristics of the subject of environmental law, the whole analysis method and the ecological research method are included in the research method system of environmental law. At the same time, it inherits the research methods of traditional jurisprudence, overcomes its limitations, and promotes the development of environmental law research in the direction of openness and diversification.
