辽宁沿海经济带建设中设立海洋特别保护区法律问题研究

【摘要】： 在我国经济和社会发展面临资源短缺压力的情况下,海洋是我国具有战略意义的资源阶梯空间。辽宁省充分利用本省海域面积广阔这一优势,大力发展海上经济,在得到国家的大力支持后,辽宁振兴沿海经济的规划有望上升为新时期的国家战略。根据此形势,本文剖析目前沿海经济带建设过程中海洋开发、利用存在的问题,提出建立辽宁海洋特别保护区并对其立法的构想。本文正文包括3章内容： 第1章介绍辽宁沿海经济带发展现状。根据笔者参加大连长兴岛临港工业区和大连庄河花园口工业园区实地调研活动中遇到的问题,综述辽宁沿海经济带建设发展的现况,以及开发、利用海洋对海洋环境的影响。 第2章为海洋特别保护区的理论基础及其法律规定现状。本章阐述了海洋特别保护区的理论基础,包括海洋特别保护区的定义、基本任务、建设原则；分析了目前我国海洋特别保护区的发展现状,并介绍了国际公约中对海洋保护区的规定和我国目前海洋保护区立法的现状。 第3章针对辽宁沿海经济带建设中海洋环境保护存在的不足,建议通过建立辽宁海洋特别保护区法律制度规范沿海经济带的经济建设活动。本章根据沿海经济带建设实践中海洋工程污染海洋环境、海域使用管理混乱、经济带建设活动破坏法律稳定性等问题,指出辽宁现有海洋开发利用保护方面的法规仍有待完善,建议制定辽宁省海洋特别保护区地方法规。本文以海洋保护区理论为基础,借鉴《海洋特别保护区管理暂行办法》、《浙江省海洋特别保护区管理暂行办法》,从海洋特别保护区的定义、立法宗旨、管理内容、管理体制、执法等方面对辽宁省海洋特别保护区立法建议进行了详细的说明。
[Abstract]:Under the pressure of the shortage of resources in the economic and social development of our country, the ocean is the strategic resource ladder space of our country. Liaoning Province makes full use of the advantages of the vast sea area of Liaoning Province and vigorously develops marine economy. With the support of the state Liaoning's plan for revitalizing the coastal economy is expected to rise to a national strategy in the new period. According to this situation, this paper analyzes the marine development in the construction of coastal economic belt at present. By using the existing problems, this paper puts forward the idea of establishing Liaoning marine special protection area and legislating it. This paper includes three chapters: chapter 1 introduces the development of Liaoning coastal economic belt. According to the problems encountered in the investigation and research activities of Dalian Changxing Island Lingang Industrial Zone and Dalian Zhuanghe Huayuankou Industrial Park, this paper summarizes the present situation of the construction and development of Liaoning coastal economic belt, as well as the impact of exploitation and utilization of the ocean on the marine environment. Chapter 2 is the theoretical basis of marine special protection area and the current situation of its legal provisions. This chapter describes the theoretical basis of marine special protected areas, including the definition of marine special protection areas, basic tasks, construction principles, and analyzes the current development of marine special protected areas in China. It also introduces the provisions of international conventions on marine protected areas and the current status of legislation on marine protected areas in China. In chapter 3, aiming at the deficiency of marine environment protection in the construction of Liaoning coastal economic belt, it is suggested that the economic construction activities of the coastal economic belt should be regulated by establishing the legal system of Liaoning marine special protected area. According to the problems of marine engineering pollution of marine environment in coastal economic belt construction practice, confusion of sea area use and management, destruction of legal stability of economic belt construction activities, this chapter points out that the existing laws and regulations on marine exploitation and utilization protection in Liaoning need to be improved. It is suggested that local laws and regulations should be formulated for special marine reserves in Liaoning Province. Based on the theory of marine protected areas, this paper draws lessons from "interim measures for the Management of Marine Special protected areas" and "interim measures for the Management of Special Marine protected areas of Zhejiang Province", from the definition, legislative purpose, management content and management system of marine special protected areas. Law enforcement and other aspects of Liaoning Province marine special protection area legislative proposals were described in detail.
