流域管理法制化的障碍与对策

【摘要】：文章通过梳理我国现行法规体系,总结出依法实施流域管理的主要障碍在于流域管理的主要法律制度存在缺位、与流域管理相关的法律法规内容上协调性不足以及流域管理立法的配套不完备等方面,只有采取制定和出台流域管理立法建设规划、创新有利于提高流域管理立法质量的体制机制、以上下联动方式推进流域管理立法、加强流域管理立法的事实和法律必要性研究等一系列综合性对策,才能不断推进流域管理法制化的实现。
[Abstract]:By combing the current system of laws and regulations in our country, this paper concludes that the main obstacle to the implementation of watershed management according to law lies in the absence of the main legal system of watershed management. The contents of the laws and regulations related to watershed management are not coordinated enough and the legislation of river basin management is not complete, so the only way is to formulate and issue the legislative construction plan for watershed management. Innovation is beneficial to the improvement of the system and mechanism of the legislation quality of watershed management, and a series of comprehensive countermeasures such as promoting the legislation of watershed management in the way of linking up and down, strengthening the research on the facts and the legal necessity of the legislation of river basin management, etc. In order to continuously promote the realization of watershed management legalization.
