生态公益林效益补偿制度法律初探

【摘要】：森林资源具有重要的经济价值与生态价值,公益林生态补偿制度是实现森林生态价值的重要途径。当前,西方发达国家和一些先进的发展中国家在公益林的生态效益补偿制度方面己取得了相当丰富且成熟的经验,而我国对公益林生态效益补偿制度的研究则起步较晚,虽然已有的政策法规对森林生态环境的保护起到了一定的作用,但现行公益林生态效益补偿制度仍存在着补偿标准低、补偿对象不明确、补偿方式单一、补偿程序缺乏保障等许多不足之处,造成森林生态效益补偿制度运行不畅。本文首先从分析公益林生态补偿制度的概念入手,介绍了我国公益林生态补偿制度的特征、结构及建立森林生态补偿法律制度的必要性；其次,介绍了目前我国相关的法律、政策环境,并在此基础上进一步论述了公益林生态补偿制度所体现的环境权、公平理论等法律理论基础;再次,通过对比世界各国森林生态效益补偿的立法规定与实践措施,对我国现行的公益林生态补偿法律制度在立法、监督等方面存在的不足进行了具体分析；最后,针对以上问题提出完善我国公益林生态补偿法律制度的设想,希望能为我国公益林生态补偿制度的发展提供一些有利的参考。
[Abstract]:Forest resources have important economic value and ecological value. Ecological compensation system of public welfare forest is an important way to realize forest ecological value. At present, the western developed countries and some advanced developing countries have obtained quite rich and mature experience in the ecological benefit compensation system of the public welfare forest, but the research on the ecological benefit compensation system of the public welfare forest in our country has started relatively late. Although the existing policies and regulations have played a certain role in the protection of the forest ecological environment, the current compensation system for ecological benefits of public welfare forests still has a low compensation standard, unclear compensation objects, and a single compensation method. There are many deficiencies in the compensation procedure, such as lack of guarantee, which result in the failure of forest ecological benefit compensation system. This paper begins with the analysis of the concept of ecological compensation system of public welfare forest, introduces the characteristics and structure of ecological compensation system of public welfare forest and the necessity of establishing the legal system of forest ecological compensation, secondly, introduces the relevant laws of our country at present. The policy environment, and on this basis, further discusses the public forest ecological compensation system embodied in the environmental rights, equity theory and other legal theoretical basis; thirdly, through the comparison of the world forest ecological benefits compensation legislative provisions and practical measures, This paper makes a concrete analysis on the shortcomings of the current legal system of ecological compensation of public welfare forest in the aspects of legislation, supervision, etc. Finally, it proposes to perfect the legal system of ecological compensation of public welfare forest of our country in view of the above problems. It is hoped that it can provide some beneficial reference for the development of ecological compensation system of public welfare forest in China.
