我国生物质能源立法研究

【摘要】： 20世纪70年代,随着世界经济的迅速发展,环境出现了严重的破坏、能源出现了短缺,人类开始意识到了环境和能源的问题,把目光都转向了可再生能源。生物质能源作为可再生能源的一种,为世界各国所青睐,他们纷纷制定生物质能源单行法来促进本国生物质能源的快速发展。目前,在我国关于生物质能源的规定主要散见于《中华人民共和国可再生能源法》和《中华人民共和国循环经济促进法》以及一些其他地方性规章之中,而且其规定也是零散的、不具有可操作性,为了解决我国的能源和环境问题,我国也迫切需要对生物质能源进行单独立法。 本论文首先从生物质能源的含义出发,系统的分析了生物质能源的特点及包含的种类,也进一步介绍了我国生物质能源发展的现状。紧接着文章从理论层面分析了我国对生物质能源进行立法的理念及立法的必要性和可行性。笔者还从法理学、立法法及环境与资源保护法的角度出发,对我国生物质能源基本法进行了建构。在文章中作者论述了我国生物质能源基本法立法的指导思想、基本目的、基本原则和基本制度。最后,笔者还对我国生物质能源立法应注意的其他问题进行了论述。以达到对我国生物质能源立法提供理论基础,为我国生物质能源的发展献计献策。
[Abstract]:In the 1970s, with the rapid development of the world economy, the environment appeared serious damage, energy appeared shortage, the human began to realize the problem of environment and energy, turned to the renewable energy. As a kind of renewable energy, biomass energy is favored by many countries all over the world. They have formulated a single law of biomass energy to promote the rapid development of biomass energy in our country. At present, the provisions on biomass energy in China are mainly found in the Renewable Energy Law of the people's Republic of China, the Circular economy Promotion Law of the people's Republic of China and some other local regulations. In order to solve the problem of energy and environment in China, it is urgent to legislate on biomass energy separately. In this paper, the characteristics and types of biomass energy are analyzed systematically from the meaning of biomass energy, and the current situation of biomass energy development in China is also introduced. Then the paper analyzes the theory of biomass energy legislation in China and the necessity and feasibility of legislation. The author also constructs the basic Law of Biomass Energy in China from the perspectives of jurisprudence, legislative law and environmental and resource protection laws. In this paper, the author discusses the guiding ideology, basic purpose, basic principle and basic system of the basic law of biomass energy in China. Finally, the author also discusses the other problems that should be paid attention to in the legislation of biomass energy in China. In order to provide the theoretical basis for the legislation of biomass energy in China, and offer suggestions for the development of biomass energy in China.
