我国森林保险法律制度探析

【摘要】：近些年来,随着国民经济发展对林木资源消耗的加快,我国森林资源之现状不容乐观。由于森林资源不可短期内再生的特殊属性,资源的稳定关系到社会的稳定以及国家的安全,所以建立和完善森林保险制度,并将这一制度上升到法律制度是当前有效保护森林资源的重要举措。 论文分六部分。第一部分从森林保险的选题背景和目的意义入手,介绍了国内外对森林保险问题的相关研究现状及发展趋势；第二部分重点介绍了我国森林保险制度提出和发展理论依据,阐述了我国森林保险的提出和发展历程,并明确提出了森林保险制度面对的挑战；第三部分具体介绍国外的现经验,通过分析美国、日本、芬兰和瑞典等几个森林保险制度比较成熟的国家的具体做法,与我国的实际相结合,得出对我国构建森林保险制度的启示和可借鉴的经验；第四部分则是通过森林保险涉及的社会层面和法律层面的多视角考量,综合分析森林保险制度对森林资源和社会经济的多种益处,指出我国建立构建我国森林保险制度的必要性；第五部分是论文的核心部分,针对目前我国森林保险存在的补足,在借鉴国外经验的基础上,提出政府扶持制度、风险预防和规避制度、风险理赔和除外制度和法律责任制度,建设性的提出了建立森林保险制度的设想；第六部分结论是对全文内容作系统的总结和对前景的展望。 论文的写作宗旨是通过调查研究,实现森林保险制度的法制化。为我国森林保险制度的建设提供法律保障,为实际操作提供可以遵循的法律依据,希望在不久的将来能够构建出一部具有可操作性的森林保险法。
[Abstract]:In recent years, with the development of national economy, the situation of forest resources in China is not optimistic. Since forest resources cannot be regenerated in a short period of time, and the stability of forest resources is related to social stability and national security, a forest insurance system should be established and perfected. It is an important measure to effectively protect forest resources to raise this system to legal system. The paper is divided into six parts. The first part introduces the status quo and development trend of forest insurance research at home and abroad, starting with the background and purpose significance of forest insurance. The second part mainly introduces the theoretical basis of the forest insurance system and its development in China, expounds the course of its development, and puts forward the challenges faced by the forest insurance system. The third part introduces the current experience of foreign countries, through the analysis of the United States, Japan, Finland and Sweden and other countries more mature forest insurance system specific practices, and China's reality, The enlightenment and experience of constructing forest insurance system in China are obtained. The fourth part is a comprehensive analysis of the benefits of forest insurance system to forest resources and social economy through the consideration of the social and legal aspects of forest insurance. The necessity of establishing forest insurance system in China is pointed out. The fifth part is the core part of the thesis, aiming at the complement of the forest insurance in our country at present, on the basis of drawing lessons from the foreign experience, the paper puts forward the government support system, the risk prevention and circumvention system, the risk claim system and the exclusion system and the legal liability system. The constructive idea of establishing forest insurance system is put forward. The sixth part of the conclusion is a systematic summary of the full text and prospects for the future. The purpose of this paper is to realize the legalization of forest insurance system through investigation and research. It provides legal guarantee for the construction of forest insurance system in our country and legal basis for practical operation. It is hoped that a workable forest insurance law can be constructed in the near future.
