促进太阳能热水器应用法律问题初探

【摘要】：伴随着能源危机和环境恶化的加剧,太阳能作为一种可再生的新能源,越来越引起人们的关注。太阳能资源的利用方式有很多,太阳能热水器则是最贴近我们生活的太阳能资源的利用方式。我国幅员辽阔,有着十分丰富的太阳能资源,这是太阳能热水器有效利用的基础条件。并且我国的太阳能热水器技术在世界上处于领先地位。虽然我国拥有全球最大的太阳能热水器生产能力及世界领先的技术水平,但现实情况是,我国的太阳能热水器普及率并不高,本文正是在这样的背景和意义下,讨论我国促进太阳能热水器应用所存在的法律和政策障碍及局限,并思考如何应对,以促进我国太阳能热水器的应用。全文主要分四个部分五个问题加以论述。重点从法律政策的角度分析了我国促进太阳能热水器的应用中遇到的问题和局限,包括太阳能获取权问题、太阳能热水器强制安装政策问题、太阳能热水器行业的产业政策问题、损害赔偿问题及太阳能热水器与建筑一体化问题。并借鉴外国立法中的先进经验,在结合我国实际情况的基础上,进而提出了我国促进太阳能热水器利用中所遇到法律问题的应对建议。最后认为,所有问题的有效解决,可以借助于我国太阳能热水器与建筑一体化的法律促进来实现,因而,最后对太阳能热水器与建筑一体化促进的法律构建进行了思考。
[Abstract]:With the aggravation of energy crisis and environmental deterioration, solar energy, as a renewable new energy, has attracted more and more attention. Solar energy resources are used in many ways, solar water heaters are the most close to our lives of solar energy resources. China has a vast territory and abundant solar energy resources, which is the basic condition for the effective utilization of solar water heaters. And China's solar water heater technology in the world in the leading position. Although China has the largest production capacity of solar water heaters in the world and the world's leading technological level, the reality is that the penetration rate of solar water heaters in China is not high. This paper discusses the legal and policy obstacles and limitations in promoting the application of solar water heaters in China, and discusses how to deal with them in order to promote the application of solar water heaters in China. The full text is divided into four parts and five problems to be discussed. The problems and limitations encountered in promoting the application of solar water heaters in China are analyzed from the angle of law and policy, including the issue of solar energy acquisition right, the policy of compulsory installation of solar water heaters. Industrial policy issues, damage compensation and integration of solar water heaters and buildings in the solar water heater industry. With reference to the advanced experience in foreign legislation and on the basis of the actual situation in our country, the author puts forward some suggestions to solve the legal problems encountered in promoting the utilization of solar water heaters in our country. Finally, it is concluded that the effective solution of all problems can be realized by means of the legal promotion of the integration of solar water heaters and buildings in China, so the legal construction of the integration of solar water heaters and buildings is considered in the end.
