我国生物质能发展中的法律问题研究

【摘要】：化石资源的过度消耗引发石油短缺和气候变暖,已成为影响人类社会可持续发展的重大问题。生物质能以其原料来源丰富、清洁环保和可再生性脱颖而出,成为各国竞相发展的重要能源。 在我国,生物质能为解决“三农”、环保、能源问题这三个世纪难题作出了重要贡献,同时也加快了我国社会主义市场经济结构的调整,但是我国生物质能的法治化进程却处于初级阶段,严重阻碍了生物质能健康、有序地发展。 本文从法律角度研究生物质能发展中的诸多问题,通过对我国生物质能法律法规和政策相关内容的介绍,分析生物质能发展过程中法律实践和法律制度上的缺陷,借鉴生物质能发展迅猛的发达国家在法律法规和政策方面的相关规定,从促进生物质能立法和完善法律制度两个层次来进行探索性研究,提出符合我国生物质能发展规律的建议对策。具体内容除了完备生物质能法律体系形成的基础条件,而且涵盖了财政管理与支出、税收、融资、产业政策、行政监管五个方面法律措施,例如加大生物质能的财政投资力度,出台生物质能基金管理办法;深入研究“燃油税”的开征条件,考虑将“生态税”作为附加税种来征收;建立独立的能源监管部门,明确规定生物质能的监管机构的职权内容和行使范围等。本文的写作意图是完善生物质能的相关立法及制度,使生物质能发展尽快走出困境。
[Abstract]:Oil shortage and climate warming caused by excessive consumption of fossil resources have become a major problem affecting the sustainable development of human society. Because of its abundant raw materials, clean environmental protection and renewable energy, biomass energy has become an important energy source for the development of various countries. In China, biomass energy has made important contributions to solving the three century problems of agriculture, rural areas, environmental protection, and energy, and has also accelerated the adjustment of the socialist market economic structure of our country. However, the legalization of biomass energy in China is in its primary stage, which seriously hinders the healthy and orderly development of biomass energy. This paper studies many problems in the development of biomass energy from the angle of law, and analyzes the defects of legal practice and legal system in the development of biomass energy by introducing the relevant contents of laws, regulations and policies of biomass energy in China. Based on the relevant provisions of laws, regulations and policies of developed countries with rapid development of biomass energy, the exploratory research is carried out from the two levels of promoting biomass energy legislation and perfecting the legal system. Some suggestions were put forward according with the law of biomass energy development in China. In addition to completing the basic conditions for the formation of the biomass energy legal system, the specific content covers five legal measures, including financial management and expenditure, taxation, financing, industrial policy, and administrative supervision, such as increasing financial investment in biomass energy. To introduce measures for the management of biomass energy funds; This paper studies in depth the conditions for the introduction of "fuel tax", considers "ecological tax" as an additional tax, establishes an independent energy regulatory department, and clearly stipulates the content and scope of exercise of the supervisory body for biomass energy. The intention of this paper is to perfect the relevant legislation and system of biomass energy, so that the development of biomass energy can get out of the predicament as soon as possible.
