我国石油天然气资源勘查开发法律问题研究

【摘要】：石油天然气资源作为一种战略资源,其安全保障作用一直以来就为世界各国所重视。就目前来看,我国石油天然气资源的勘查开发始终是国务院相关部门及油气富集地区的地方各级政府所关注的焦点,石油天然气资源相关的法律问题研究才刚刚起步,有关勘查开发方面的法律制度也并不健全。本文通过梳理我国石油天然气资源勘查开发概况与相关立法现状,选取部分国家石油天然气资源勘查开发立法经验进行分析,结合我国石油天然气资源勘查开发立法拟解决的主要问题,提出了建立和完善我国石油天然气勘查开发法律制度的具体建议。本文的创新之处在于提出了构建开发权管理体制,设置市场准入条件,加大财税政策激励,加强产业安全审查和环境保护等对策建议。
[Abstract]:As a kind of strategic resources, oil and gas resources have been attached great importance to all over the world. At present, the exploration and development of oil and gas resources in China has always been the focus of attention of the relevant departments of the State Council and local governments at various levels in oil-gas enrichment areas. The study on legal issues related to oil and gas resources has only just begun. The legal system on exploration and development is also not sound. By combing the general situation of petroleum and natural gas resources exploration and development in China and the current situation of relevant legislation, this paper analyzes the legislative experience of oil and gas resources exploration and development in some countries. Combined with the main problems to be solved by the legislation on the exploration and development of petroleum and natural gas resources in China, some concrete suggestions are put forward to establish and perfect the legal system for the exploration and development of petroleum and natural gas in China. The innovation of this paper is to put forward some countermeasures and suggestions, such as constructing the management system of development right, setting up the condition of market access, increasing the incentive of fiscal and taxation policy, strengthening the industrial safety examination and environmental protection.
