山区环境政策法律化研究

【摘要】：山区环境政策法律化的研究,不仅是我国环境法制完善的一个重要方面,更是国家乃至全球的可持续发展的重要保障,更能体现人与自然的和谐关系以及人类世代间的责任感。由于山区具有其独特的生态功能,仅靠自然保护区与生态功能保护区政策法规的调整是达不到山区环境有效保护的。我国产权制度不明晰、山区环境保护过程中政府的越位与市场的缺位,以及经济和社会因素的影响之下,现今山区环境政策体系杂乱、逻辑联系不强以及互相冲突严重的问题已经十分显著,不仅有碍于山区的可持续发展,而且也阻碍了我国生态文明社会的建设,因而山区环境政策法律化是势在必行。 本文以山区环境政策法律化为切入点,将山区整体的综合性立法研究作为目标。山区环境政策杂乱需要将其条理化、系统化;山区环境政策缺乏执行力,应进一步加强法律制度建设明确环境责任;政策实行缺乏经济保障,可借鉴国外经验结合国内实践建立中央与地方两级山区基金管理制度;政策缺乏稳定性、连续性、无权威性和可信度等缺陷,建立山区综合管理机构保障政策与法律实施的稳定性。我国山区环境政策研究已具备一定的理论和实践基础,山区环境政策法律化的路径,应以山区整体可持续发展为目标,选择山区综合性立法的基本法模式。山区环境政策法律化应根据我国山区生态功能意义,保护山区环境与资源;保护自然景观和生物多样性;鼓励发展有利于山区环境保护的经济活动。遵循可持续发展原则;综合决策原则;山区环境保护优先原则;一体化保护原则。山区环境政策法律化应重点集中于建立山区综合管理制度、建立山区基金管理制度、完善山区生态补偿制度和明确山区环境法律责任几方面制度。
[Abstract]:The study on the legalization of environmental policy in mountainous areas is not only an important aspect of the perfection of environmental legal system in our country, but also an important guarantee for the sustainable development of our country and even the whole world. It can also reflect the harmonious relationship between man and nature and the sense of responsibility between human generations. Because the mountain area has its unique ecological function, the adjustment of the policies and regulations of the nature reserve and the ecological function reserve can not achieve the effective protection of the mountain environment. Under the influence of economic and social factors, the environmental policy system in mountainous areas is chaotic, due to the unclear property rights system, the offside of government and the absence of market in the process of environmental protection in mountainous areas. The problems of weak logical connection and serious conflict have been very obvious, which not only hinder the sustainable development of mountain area, but also hinder the construction of ecological civilization society in our country. Therefore, it is imperative to legalize the environmental policy of mountain area. This article regards the environmental policy legalization of mountain area as the starting point, taking the comprehensive legislative research of the mountain area as the goal. It is necessary to systematize the environmental policies in mountainous areas, and to strengthen the legal system to make the environmental responsibility clear. The implementation of the policy lacks economic security, so we can draw lessons from foreign experience and combine domestic practice to establish the management system of mountain funds at the central and local levels. The policy is short of stability, continuity, authority and credibility, and the establishment of comprehensive management institutions in mountain areas ensures the stability of the policy and the implementation of the law. The research of mountain environmental policy in our country has a certain theoretical and practical foundation. The path of legalization of mountain environmental policy should aim at the overall sustainable development of mountain area and choose the basic law mode of comprehensive legislation in mountainous area. The legalization of mountain environmental policy should protect mountain environment and resources, protect natural landscape and biodiversity, and encourage the development of economic activities beneficial to mountain environmental protection according to the significance of mountain ecological function. Follow the principle of sustainable development; the principle of integrated decision-making; the priority of mountain environmental protection; the principle of integrated protection. The legalization of environmental policy in mountainous areas should focus on the establishment of comprehensive management system of mountain areas, the establishment of management system of mountain funds, the improvement of ecological compensation system in mountainous areas and the clarification of legal liability system of mountain environment.
