确立新的能源价格形成机制的法律思考

【摘要】： 我国能源的供应与消费已进入新的历史阶段,越演越烈的能源问题与本届政府提出的科学发展观和建设生态文明社会的目标背道而驰。为了确保能源与社会经济、环境的协调发展,必须树立科学发展观,首先保证我国能源的可持续发展。尤其是在当前全球金融危机愈演愈烈,世界经济日渐衰退的背景下,中国应该抓住全球大宗商品价格大跌的时机,化危为机,依法确立新的能源价格形成机制,推动我国经济的复苏和崛起。 本文通过对我国能源发展状况和现行能源定价机制及相关能源法律的分析研究,结合相关能源法律,从可持续发展的角度出发,对建立新的能源价格机制进行了深入的思考,并且对完善我国能源立法提出了建议。本论文的创新之处在于:首先,提出针对中国现存的能源短缺问题,改善能源的定价机制,用市场手段调整市场供需,同时政府运用财政、税收等手段对市场机制进行补充。其次,以可持续发展理论为指导,健全能源法律体系,鼓励发展新能源和可再生能源,促进能源多元化,保证合理开发利用能源,实现又好又快发展。本论文的工作对引导能源价格机制的改革,尤其是完善能源法律制度具有重要的意义。
[Abstract]:The supply and consumption of energy in our country has entered a new historical stage. The increasingly intense energy problem runs counter to the scientific development concept and the goal of building ecological civilization society put forward by this government. In order to ensure the coordinated development of energy, social economy and environment, it is necessary to set up a scientific concept of development, first of all, to ensure the sustainable development of energy in China. Especially in the context of the current global financial crisis and the increasing recession of the world economy, China should seize the opportunity of the global commodity price drop, turn the crisis into an opportunity, and establish a new energy price formation mechanism in accordance with the law. Promote China's economic recovery and rise. Based on the analysis and study of the current energy pricing mechanism and the related energy laws in China, and combining with the relevant energy laws, this paper makes a deep thinking on the establishment of a new energy price mechanism from the perspective of sustainable development. And put forward the suggestion to consummate our country energy legislation. The innovation of this paper lies in: first of all, we propose to improve the pricing mechanism of energy, adjust the supply and demand of the market by market means, and supplement the market mechanism by means of finance and taxation. Secondly, under the guidance of the theory of sustainable development, we should perfect the legal system of energy, encourage the development of new and renewable energy, promote the diversification of energy, ensure the rational development and utilization of energy, and realize sound and rapid development. The work of this paper is of great significance to guide the reform of energy price mechanism, especially to perfect the energy legal system.
