我国环境突发事件应急法律机制研究

【摘要】：近几年来,环境突发事件频发,其频率之高、危害之大都已经达到了前所未有的程度。运用健全而科学的法律机制防控环境突发事件是现阶段防治和治理环境突发事件的最好方法,也是社会主义法治国家的必然选择。而目前我国环境突发事件应急法律机制还不健全,机制的具体内容、原则、体制等问题仍需要进一步研究。因此,本文选择对我国环境突发事件法律机制问题进行研究,以期为我国环境突发事件应急法律机制的正式确立奠定基础、丰富理论研究成果。 本研究课题以环境突发事件为着眼点进行研究,结合环境突发事件的自身特点进行阐释,继而分析了应急法律机制的内涵,在考察国内外环境突发事件法律机制现状和研究成果的基础上总结和借鉴经验,进一步完善我国环境突发应急法律机制的具体内容,包括:环境突发事件应急法律机制的法律完善、遵循基本原则完善、具体制度完善和法律责任完善等。最终,建立我国较为科学合理的环境突发事件应急法律机制。
[Abstract]:In recent years, environmental emergencies occur frequently, its frequency and harm have reached an unprecedented level. Using a sound and scientific legal mechanism to prevent and control environmental emergencies is not only the best way to prevent and control environmental emergencies at present, but also the inevitable choice of socialist country ruled by law. At present, the legal mechanism of environmental emergency is not perfect in our country, the concrete content, principle and system of the mechanism still need to be further studied. Therefore, this paper chooses to study the legal mechanism of environmental emergencies in China in order to lay a foundation for the formal establishment of the legal mechanism of environmental emergencies and enrich the theoretical research results. This study focuses on environmental emergencies, explains the characteristics of environmental emergencies, and then analyzes the connotation of emergency legal mechanism. On the basis of reviewing the current situation and research results of the legal mechanism of environmental emergencies at home and abroad, this paper summarizes and draws lessons from the experience, and further improves the concrete contents of the legal mechanism of environmental emergencies in China. It includes: the legal perfection of the environmental emergency legal mechanism, the perfection of the basic principles, the perfection of the concrete system and the perfection of the legal responsibility, etc. Finally, establish our country more scientific and reasonable environmental emergency legal mechanism.
