中部地区农村城镇化的环境法治问题研究

【摘要】： 推进农村城镇化,提高农村城镇化发展水平,是我国经济和社会发展的一项重要内容。目前,我国的农村城镇化水平还比较低,不能适应国民经济持续发展的要求,因此必须采取有力措施,加快我国的农村城镇化水平。然而随着中部地区农村城镇化的不断发展,中部六省小城镇的环境问题日益严重,这不仅不利于当地社会经济的可持续发展,而且对广大小城镇居民的身体健康造成了危害。解决这一问题涉及到社会的多个方面,而加强中部地区农村城镇化的环境法治建设是重中之重。全面繁荣中部地区小城镇经济,必须要重视小城镇生态系统的整体性与环境问题的特殊性,坚持依靠法治手段协调好小城镇人口、资源、环境、社会、经济的关系,坚持走可持续发展之路。 农村城镇化对生态环境产生了不利影响,中部地区农村城镇化过程中出现了各种环境问题,表现为生活环境污染严重,乡镇企业污染不断加剧,土地资源破坏、浪费严重,历史文化遗迹破坏等。中部地区农村小城镇环境法治存在一系列问题,立法上存在严重的大城市中心主义,地方环境立法起步较晚,没有突出中部地区的地方特色;执法上存在环保执法体系不健全和执法力度不够等问题;司法机关在解决环境纠纷、促进环境保护的作用远未发挥;公众的环保意识普遍较差,对环境保护法的了解不够;在司法监督领域缺乏环境监督。中部地区农村城镇化对环境法治产生冲击,表现为政府的环境保护责任意识淡薄,地方保护主日益严重,环境法制建设遭遇更大困境。完善中部地区农村城镇化的环境法治,在立法上要完善实现环境正义、体现可持续发展思想的环境立法,包括国家环境立法与地方环境立法;在执法上要健全执法体系,突出环境执法重点;要重视环境司法,包括完善环境权利司法救济机制,建立环境公益诉讼,设立环境法律援助制度;加强环境保护的普法教育,提高公众的环保意识;完善环境法律社会监督机制。
[Abstract]:Promoting rural urbanization and improving the development level of rural urbanization is an important part of China's economic and social development. At present, the level of rural urbanization in China is still relatively low, which can not meet the requirements of the sustainable development of the national economy, so we must take effective measures to speed up the level of rural urbanization in our country. However, with the continuous development of rural urbanization in the central region, the environmental problems of small towns in the six provinces of central China are becoming more and more serious, which is not only unfavorable to the sustainable development of local social economy, but also harmful to the health of the residents of small towns. Solving this problem involves many aspects of society, and strengthening the construction of environmental rule of law in rural urbanization in central China is the most important. In order to prosper the economy of small towns in the central region in an all-round way, we must attach importance to the integrity of the ecosystem of small towns and the particularity of environmental problems, persist in coordinating the relationship among population, resources, environment, society and economy of small towns by means of the rule of law, and persist in taking the road of sustainable development. Rural urbanization has had a negative impact on the ecological environment. In the process of rural urbanization in the central region, there have been various environmental problems, such as serious pollution of living environment, increasing pollution of township enterprises, destruction of land resources, serious waste, destruction of historical and cultural relics, and so on. There are a series of problems in the environmental rule of law in rural small towns in the central region, there are serious big city centralism in legislation, the local environmental legislation starts late and does not highlight the local characteristics of the central region, there are some problems in the law enforcement, such as the imperfect environmental law enforcement system and the insufficient law enforcement strength, and the role of the judicial organs in resolving environmental disputes and promoting environmental protection is far from being brought into play. Public awareness of environmental protection is generally poor, lack of understanding of environmental protection law, lack of environmental supervision in the field of judicial supervision. The rural urbanization in the central region has an impact on the environmental rule of law, which is manifested in the weak awareness of the government's responsibility for environmental protection, the increasing severity of the local protectors, and the greater difficulties encountered in the construction of the environmental legal system. In order to perfect the environmental rule of law of rural urbanization in the central region, we should perfect the environmental legislation to realize environmental justice and embody the thought of sustainable development, including national environmental legislation and local environmental legislation, perfect the law enforcement system and highlight the key points of environmental law enforcement, attach importance to environmental justice, including perfecting the judicial relief mechanism of environmental rights, establishing environmental public interest litigation and establishing environmental legal aid system. Strengthen the education of popularizing the law of environmental protection, improve the public awareness of environmental protection, and improve the social supervision mechanism of environmental law.
